Board of Appeals Wednesday, May 13, 1992 4 . <br /> Engineer Christopher Costa represented the applicant . <br /> Mr. Costa stated that the Variance application was required <br /> after a hearing on a Special Permit to allow a 5 ' setback from the <br /> lot line . The location is necessitated by location of other piers in <br /> the area. Mr. Costa explained that the topography of the lot and <br /> amount of salt marsh required this placement . He said that D.E. P. <br /> and the Corps of Engineers will be licensing the pier. <br /> Mr. Makunas moved to grant the Variance allowing a 5 ' setback <br /> from the westerly side line . C. Hawver seconded . All agreed . <br /> Advisement : Mr. Friel explained that the same applicants had a <br /> Special Permit application under advisement . Members sitting : J . <br /> Friel, M . Makunas and E. Govoni . <br /> Mr. Govoni moved to grant the Special Permit . Mr. Makunas <br /> seconded . Govoni <br /> Mr. Govoni questioned the Building Inspector if he was satisfied <br /> with the way the house was built and Mr. Boyd replied that he was not <br /> satisfied at all times . Mr. Boyd said he was now satisfied and that <br /> the problems had been corrected. Mr. Makunas referred to the Minutes <br /> of the April 22, 1992 and asked if the applicants had acted in good <br /> faith and had some misunderstandings which resulted in errors . Mr. <br /> Boyd confirmed that there was confusion on the plans used . <br /> Ralph Crichton, an abutter, stated that he was opposed and <br /> questioned the height of the building . Mr. Boyd said he was satisfied <br /> that height had been certified by licensed engineers . Mr. Costa <br /> stated that Greg Taylor, Director of the DPW, had been asked to get <br /> some idea of the height but he was not acting as a professional <br /> engineer. It was not a certified plan. <br /> Mr. Crichton questioned the location of the septic system and <br /> Mr. Costa said the owner had built a deck near the septic system and <br /> the Board of Health had remeasured the field and found no violations . <br /> Mr. Costa explained the Board of Health restrictions on Title V <br /> permits . James Crichton, a neighbor, asked to review the plans . Ralph <br /> Crichton questioned which plan was being used and Mr. Friel explained <br /> that the plan for this hearing is an accurate plan of the house . <br /> Mr. Friel stated that the Building Inspector is now satisfied and Mr. <br /> Boyd said that two engineers have put their reputation on the line as <br /> to the lot coverage. <br /> Ms . Hawver moved to grant the Special Permit referenced by plans <br /> of Joseph Ferrara dated 1/13/92 and revised 1/22/92 . Mr. Govoni <br /> seconded . All agreed . <br /> Mr. Crichton asked for names of members who had voted . <br />
