TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, April 22, 1992 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, April 22, 1992 <br /> at 7:30 P.M. at the Mashpee Town Hall. Board members present and acting <br /> throughout were Michael A. Makunas, Cheryl A. Hawver, John J. Friel and Edward <br /> M. Govoni. Mr. Makunas called the meeting to order at 7:40 P.M. <br /> James E. & Priscilla Ann Griffin - Request a Variance from Section 174-31 <br /> of the Zoning By-laws for permission to vary the setback requirements in <br /> an R-3 zoning district on property located at 70 Summersea Road (Map 105, <br /> Block 37) Mashpee, MA. <br /> James E. & Priscilla Ann Griffin -- Request a Special Permit under Section <br /> 174-17 of the Zoning By-laws for permission to expand a non-conforming <br /> dwelling with a second-floor room in an R-3 zoning district on property <br /> located at 70 Summersea Road (Map 105, Block 37) Mashpee, MA. <br /> Members sitting: M. Makunas, C. Hawver, J. Friel <br /> Realtor Joan Muse represented the applicant. An abutter to the property, <br /> John Goncar, asked for the definition of a nonconforming dwelling. Mr. <br /> Makunas explained that properties which do not meet current zoning are <br /> considered non-conforming. <br /> Ms. Muse explained that the entire village of Summersea was thought to be <br /> in the original New Seabury Special Permit area under cluster zoning without <br /> the setback requirements. In 1988 when the Master Plan was submitted to <br /> the Town many properties were found to be outside of the permit area. This <br /> property, as well as that of the abutters, is not in the Special Permit area. <br /> She explained that Variances will be required on many properties in order <br /> to obtain clear title. <br /> Mr. Makunas asked for an explanation on the Special Permit request and Ms. <br /> Muse explained that the buyer of the property would like to add a second-floor <br /> bedroom to a ranch house. Ms. Muse explained that the property is well below <br /> street level and the bedroom would require the addition, of a dormer. Bruce <br /> Devlin, architect, explained that a 20' x 16' area would be raised at the <br /> center of the roof. <br /> Mr. Friel moved to grant the request for a Variance. Ms. Hawver seconded. <br /> All agreed. <br /> Mr. Friel moved to grant the request for a Special Permit. Ms. Hawver <br /> seconded. All agreed. <br />
