Welch - Request a Special Permit under Section 174-17 of <br /> the Zoning By-laws for permission to expand a non-conforming structure with <br /> the addition of a garage in an R-5 zoning district on property located at <br /> 55 Sunset Circle (Map 64, Block 23) Mashpee, MA. <br /> Alfred & Susan C. Welch - Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the setback requirements in an R-5 zoning <br /> district on property located at 55 Sunset Circle (Map 64, Block 23) Mashpee, <br /> MA. <br /> Members sitting: M. Makunas, C. Hawver, J. Friel <br /> Dave Sanicki of Cape & Islands Engineering represented the applicants. He <br /> informed the Board that the applicant wishes to build a garage and there <br /> has been a zoning change since the house was purchased. The current zoning <br /> requires 25' side line setbacks making it impossible to place the garage. <br /> He stated that the topography of the lot allows only one area for building. <br /> Mr. Makunas asked that the record show that he and Mr. Govoni live in the <br /> neighborhood but are not abutters. Mr. Philaris, a direct abutter, asked <br /> what the height of the proposed structure would be. Mr. Sanicki presented <br /> a sketch and stated that height would be 17.3' , standard height for a garage. <br /> No living space was planned over the garage. Mr. Philaris stated he would <br /> like some landscaping done between the garage and the lot line. Mr. Edward <br /> Carrier, an abutter, said he was sure owner would landscape and he felt it <br /> would be an improvement in the neighborhood. Mr. Sanicki suggested that <br /> permit could require landscaping on the southerly side of garage. <br /> Realtor Joan Muse stated that she had built the house and that a mistake <br /> had been made in the foundation placement and she said she had spoken to <br /> the owner and he would agree to landscaping. <br /> Mr. Makunas asked that the sketch of garage be made a part of the decision. <br /> Mr. Friel moved to grant the Special Permit subject to the condition that <br /> appropriate landscaping be installed adjacent to the garage. Ms. Hawver <br /> seconded. All agreed. <br /> Mr. Friel moved to grant the Variance allowing a 10.1 ' sideline setback. <br /> Ms. Hawver seconded.
