Board of Appeals Minutes - April 22, 1992 3 . <br /> Attorney Michael Dunning represented the applicant. He stated that the <br /> applicants had received a Special Permit to remove a seasonal cottage and <br /> replace it with a year-round home. He said the architect had some <br /> modifications in the plans which he reviewed with the Building Inspector. <br /> He said the changes resulted in the lot coverage increasing from 19.6% of <br /> the lot to 19.9% and the height went from 34' to 34'11". Both of those are <br /> within the allowable limits of the zoning by-laws and a building permit <br /> was issued. <br /> Mr. Dunning said that the structure as built had been approved and modified <br /> by the Building Inspector. fie asked for the modification based on plans <br /> submitted. He stated that what was built is not substantially more <br /> detrimental to the area that the original proposal. Joseph Ferrara, the <br /> architect, confirmed Mr. Dunning's statement that he had met on several <br /> occasions with the Building Inspector to review the changes. Mr. Makunas <br /> explained that the original drawings were part of the original Special Permit <br /> and any modifications should have been requested from the Board of Appeals <br /> and not the Building Inspector. <br /> Mr. Ferrara explained that they had changed the ridge direction to try to <br /> incorporate the chimney in the building to make the design more in a cape <br /> style. Mr. Makunas noted that 18 letters had been received in favor of the <br /> application and one letter opposed. Mr. Makunas asked what was actual <br /> increase in square footage and Mr. Ferrara replied that it was 25 sf. Mr. <br /> Dunning stated that he regrets that the applicants did not return to the <br /> Board of Appeals but that they had acted in good faith. <br /> There was discussion of comments from the Town Planner on the height measured <br /> from the original grade and Mr. Dunning stated that engineers had been <br /> retained to certify the height. Mr. Makunas stated that he would like to <br /> review the plans with the Building Inspector. <br /> Ms. Hawver moved to take the application under advisement. Mr. Govoni <br /> seconded. All agreed. <br /> Mr. Makunas said the public hearing was closed on this matter. Mr. Dunning <br /> asked if there was dramatic divergence in opinion that he have the opportunity <br /> to address it and Mr. Makunas agreed. <br /> Doris P. Salzer: Requests a Special Permit under Section 174-25.I.9 of the <br /> Zoning By-laws for an existing pier, ramp and floats on Popponesset Crekk <br /> in an R-3 zoning district on property located at 76 Spoondrift Way (Map 112, <br /> Block 42) Mashpee, Ma. <br /> Members sitting: M. Makunas, C. Hawver, J. Friel <br /> Engineer John Slavinsky represented the applicant. He presented plans of <br /> a dock built in 1969 with an Army Corps of Engineers permit but did not have <br /> a Chapter 91 license. In order to file with the Conservation Commission <br /> a Special Permit is needed from the Board of Appeals. Mr. Friel moved to <br /> grant the Special Permit. Ms. Hawver seconded. All agreed. <br />
