Hoard of Appeals Minutes - March 11, 1992 2 . <br /> Edwin M. and VirginiA D. Thomas - Request a Special Permit <br /> under Section 174-25 . 1 . 9 of the Zoning by-laws for permission <br /> to construct a pier on Popponesset Creek in an R-3 zoning <br /> district on property located at 46 Spoondrift Way (Map 111 , <br /> Block 128) Mashpee, MA. <br /> Members sittings M. Makunas, C. Hawver, J. Friel <br /> Engineer Christopher Costa represented the applicant and <br /> presented plans for a dock. He explained that he had met with <br /> the Shellfish Warden last year to resolve any problems in <br /> locating the pier and he asked for a design which would not <br /> displace shellfish beds . Mr. Costa said the resolution was a <br /> narrower t-shaped design which would be permanent . Mr. Costs <br /> explained that the original plans did not have information on <br /> soundings and revised plans were presented to the Waterways <br /> Commission. Comments were received from Waterways Commission <br /> questioning if dock would obstruct traffic in the narrow <br /> channel . <br /> Mr. Friel moved to grant the Special Permit with the condition <br /> that the pier is limited to two boats and, at all timer, they <br /> will be moored on the outside of the pier. Ms . Hawver <br /> seconded . All agreed . <br /> Linda Raub Zammer - Requests a Variance from Sections 174-9, <br /> 174-31 and 174-40 of the Zoning By-laws for permission to vary <br /> the setback requirements in a C-1 zoning district on property <br /> located at 620 Falmouth Road (Map 74, Block 6 ) Mashpee, MA. <br /> (Owner of record : Jorlen Corp. ) Continuation of Special <br /> Permit application from February 26, 1992 ) <br /> Members sitting : M. Makunas, C. Hawver, J . Friel <br /> Douglas Storrs represented the Petitions . He said they have <br /> revised plans based on traffic concerns expressed by the <br /> Selectmen, the DPW director and the State District 7 <br /> engineers . He explained that one of the entrances on Donna ' s <br /> Lane has been eliminated . He said they have been asked by <br /> State District 7 to update the curb cut permit and that the <br /> State will be looking for either a paved shoulder on the east <br /> side or restrictions as to right in, right out . Mr. Makunas <br /> asked who would pay for the work and Mr. Storrs replied that <br /> it would be his responsibility. He said only the State can <br /> mandate how traffic will be handled . <br /> Mr. Makunae questioned the improvement of Donna' s Lane to the <br /> rear entrance to the property. Mr. Storrs said he was in <br /> negotiation with the Selectmen on improving Donna' s Lane from <br /> 28 to Great Neck Road. 1f those negotiations succeed Donna' s <br /> Lane will be a two lane road . 1f they do not, Mr. Storrs <br /> would be responsible for improving Donna ' s Lane from Route 28 <br /> to the rear property line.
