Board of Appeals Minutes - February 12, 1992 3 . Mr . Daniels asked that the hearing be continued pending additional plans . Mr. Friel asked if the new owners, the Solomons , had retained a lawyer to examine the deed when the property was purchased . Mr. Solomon explained that they had . He said he had been able to park three cars on their own lot . Mr . Friel stated that there should be legal plans of both properties . Mr . Tarabelli explained that the Board of Health had required that the water lines be enclosed that that it had been necessary to dig in the driveway to locate them. He said no heavy equipment was used . He said the fence was not broken but some of the ties taken down because the water line was under it . He said he had reviewed this with the Fergueons and they had agreed to the work and Mr. Tarabelli said the property would be restored to the original condition . Mr . Solomon said he had met with Mr . Ferguson February 4 and told him that whatever damage had been done would be repaired totally . He claimed ,that Mr. Ferguson had stated that he could make it easy or difficult for the Solomons . Mr. Daniels asked that the record show he took complete exception to that statement . Mr . Friel said he felt a definitive plan was necessary showing the bounds and the easement . Mr. Makunas asked Mr. Ferguson if he had seen the plans and had any problem with the design or the reconstruction. Mr . Ferguson replied that the deck was part of the issue and that he had not had enough time to study the plans . Mr . Friel moved to take the application underadvisement subject to the delivery of an engineer ' s site plan showing the driveway and the easement in question . Mr . Makunas said they should show that they have not encroached on the easement without permission . Mr . Friel stated he wanted to see the abutters ' properties on the site plan. Ms . Hawver seconded . All agreed . Virginia Landry of the Popponesset Beach Association discussed the easements given to install Highwood Water in the area . Krizansk - The Board received a letter from Attorney Kevin Kirrane requesting a minor modification on the Special Permit issued to the Krizanskys . Mr. Makunas said the Board had nothing to act on. Ms . Landry said she would prefer a new hearing . Mr. Makunas stated that once the Board had received plans they would determine if a new hearing was necessary.
