Board of Appeals Minutes - February 12, 1992 3 . <br /> Mr . Daniels asked that the hearing be continued pending <br /> additional plans . Mr. Friel asked if the new owners, the <br /> Solomons , had retained a lawyer to examine the deed when the <br /> property was purchased . Mr. Solomon explained that they had . <br /> He said he had been able to park three cars on their own lot . <br /> Mr . Friel stated that there should be legal plans of both <br /> properties . <br /> Mr . Tarabelli explained that the Board of Health had required <br /> that the water lines be enclosed that that it had been <br /> necessary to dig in the driveway to locate them. He said no <br /> heavy equipment was used . He said the fence was not broken <br /> but some of the ties taken down because the water line was <br /> under it . He said he had reviewed this with the Fergueons <br /> and they had agreed to the work and Mr. Tarabelli said the <br /> property would be restored to the original condition . <br /> Mr . Solomon said he had met with Mr . Ferguson February 4 and <br /> told him that whatever damage had been done would be repaired <br /> totally . He claimed ,that Mr. Ferguson had stated that he <br /> could make it easy or difficult for the Solomons . Mr. <br /> Daniels asked that the record show he took complete exception <br /> to that statement . <br /> Mr . Friel said he felt a definitive plan was necessary <br /> showing the bounds and the easement . Mr. Makunas asked Mr. <br /> Ferguson if he had seen the plans and had any problem with <br /> the design or the reconstruction. Mr . Ferguson replied that <br /> the deck was part of the issue and that he had not had enough <br /> time to study the plans . <br /> Mr . Friel moved to take the application underadvisement <br /> subject to the delivery of an engineer ' s site plan showing <br /> the driveway and the easement in question . Mr . Makunas said <br /> they should show that they have not encroached on the <br /> easement without permission . Mr . Friel stated he wanted to <br /> see the abutters ' properties on the site plan. Ms . Hawver <br /> seconded . All agreed . <br /> Virginia Landry of the Popponesset Beach Association <br /> discussed the easements given to install Highwood Water in <br /> the area . <br /> Krizansk - The Board received a letter from Attorney Kevin <br /> Kirrane requesting a minor modification on the Special Permit <br /> issued to the Krizanskys . Mr. Makunas said the Board had <br /> nothing to act on. Ms . Landry said she would prefer a new <br /> hearing . Mr. Makunas stated that once the Board had received <br /> plans they would determine if a new hearing was necessary. <br /> Non--conformin_q_ uses - Mr. Friel asked the secretary to send <br /> the latest Land Use Manager to Selectman Mills . <br />
