TOWN OF MASHPEE <br /> .Beard of Appeals <br /> Minutes <br /> January ?2, 1992 <br /> The Mashpee Board of Appeals hold a meeting on Wednesday, <br /> January 22, 1992 at 7 : 30 P. M . at the Hnshpee Town Hall . <br /> Board members present and acting throughout were : William J . <br /> Hanrahan, Michael A . Makunas, Cheryl A . Hawver, John J . Friel <br /> and Edward M . Govoni , Building Inspector Douglas S . Boyd was <br /> in attendance , <br /> Steven R . Ball - Requests a Variance from Section 174-31 of <br /> the Zoning By-- laws for permission to very the side line <br /> setback requirement in an R--3 zoning district on property <br /> located at 53 Amy Brown Road ( Map 109 , Block 1 ) Mashpee, MA . <br /> ( Owner or record : Richard E. Ball ) . <br /> Members sitting : W . Hanrahan, M . Makunas , C . Hawver <br /> Steven Ball represented his application . He explained that <br /> he had wanted to repair a 9 ' x b ' old shed and filed with <br /> Conservation . He said Conservation approved replacing the <br /> shed with an h ' x 12 ' shed moved further back 15 ' from the <br /> old shed which he did without a permit . A complaint was <br /> received from a direct abutter since the new shed was in <br /> violation of the side set back requirements . <br /> Mr. Hanrahan read comments from Thomas Fudala, Town Planner, <br /> stating that the lots were illegally subdivided and a letter <br /> was received from a direct abutter, Paul Martick, opposing <br /> the variance . <br /> Mr . Boyd explained that there was one building permit for the <br /> existing shed but there are now two sheds . The new shed <br /> should have been built 15 ' upland and 15 ' from the lot line . <br /> He said Conservation would not permit repair of the old shed . <br /> Mr . Makunas Said there is no solution to this but to go <br /> before Conservation again and move the shed . It is not a <br /> zoning problem . There is no hardship and an abutter opposed . <br /> Ms . Hawver explained there are no options . <br /> Ms . Hawver moved to deny with prejudice . Mr. . Makunas <br /> seconded . All agreed . <br />
