Hao rahan <br /> seconded . <br /> - Requests a Special Permit under Section <br /> 174-25 , 1 . 9 of the Zoning By- laws for peimi-ssion to build a <br /> dock consisting of a pier, ramp and t1oato in an R -3 zoning <br /> district on property located at 226 Wading Place Road ( Map <br /> 119, Block 59 ) Mashpee, KA , <br /> Members sitting : M . Makunas , J . Friel , E . Govoni. <br /> Mr . Hanrahan explained that the Board had received o letter <br /> from Attorney Hencby requesting withdrawal without prejudice . <br /> Mr . Town Counsel stating <br /> that the Board does not have any petition to hear on this . <br /> Mr. Makunas questioned how legal opinion was received and it <br /> was explained that it was done during regular Town Hall hours <br /> with counsel . <br /> Mr . Boyd said he questioned if the permit can be modified to <br /> reflect the structure as built . MT . Makunas said the Board <br /> has not received any request fox modification or appeal . Mr . <br /> Boyd said the owner had corrected everything except the <br /> dormou . He said there was concern about height and lot <br /> coverage . <br /> Virginia Landry asked if the abutters have any rights . Mr , <br /> Makunas said the abutters can notify the Building Inspector of <br /> violations and then appeal his action or inaction to the Doard <br /> of Appeals . <br />
