The Board found in favor of the Petitioner <br /> and determined that the relief granted by the Variance is still <br /> in effect and the stop work order should be rescinded for the <br /> following reasons: <br /> • substantial construction of at least one dwelling ocured <br /> Within the first year of the Variance <br /> 2 , since all of the lots were contained in one decision the <br /> construction of a single dwelling satisfies the <br /> "substantial construction" requirement. <br /> Mr. Regan seconded. All agreed, <br /> Mr, Kirrane asked t . Withdraw the request for a Variance . <br /> Mr. Mak nas moved to accept the request to withdraw, Mr. Regan <br /> seconded, All agreed, <br /> Donald H . Priestley TR. has Appealed the Decision of the <br /> Building Inspector in the issuance of a Stop Work Order for a <br /> zoning violation in the construction of a single-family <br /> dwelling in an R-5 zoning district on property located at 147 <br /> Names Circle Map 71 , Block 182 ) . 141 Janes Circle Map 71, <br /> Block 183 ) . and 125 James Circle (Map 71, dock 184) Mashpee, <br /> Ma. (owner of record: Richard M. Scudder TRS. ) <br /> Attorney Robert mills said he concurred with Attorney Kirrane <br /> that construction on one of the lots was sufficient. He said <br /> Mr. Priestley had received transfers of building permits in <br /> November, 1993 and that more than $5 , 500 was spent in improving <br /> drainage on lots .
