MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 28, 2018 <br /> The current zoning is 150 ft. of frontage, which means this application would require a 50 <br /> ft. variance. The typography and soil conditions of the lot relative to the fact that a good <br /> portion of this lot is now marshland and a need to locate the septic system in the front of <br /> the building certainly grants enough factual data for the Board to grant relief from both the <br /> front yard setback and the wetlands. <br /> Mr. Kirrane in his closing remarks said that this lot is the last undeveloped lot,and believes <br /> that because the Planning Board approved the 1981 plan is a contributing factor to the <br /> current situation of this lot. There were several letters of support from the neighbors for the <br /> variance relief. <br /> Mr. Coffee approached the Board and read his letter into the record.He is hoping to become <br /> the new homeowner of 31 Amy Brown Road. He commented on the condition of the road <br /> being a hazardous for travelling. <br /> Mr. Bonvie said he spent time discussing this situation with the Building Commissioner. <br /> He said in his opinion that there was a time when an ANR plan depicted some zoning <br /> compliance. He said in the last several years,the Planning Boards no longer stamp the plan <br /> but doesn't mean it's considered a buildable lot, or meets the minimum requirements. He <br /> wanted clarification on this. The Town Planner said that an ANR Plan from the Planning <br /> Board does not endorse a lot's buildability. Mr. Bonvie is more concerned about the <br /> comment sent by the Fire Chief, and a house being located on this lot. <br /> Mr. Bonvic read the letter dated March 27, 2018, from Fire Chief Thomas C. Rullo into <br /> the record stating he is against the proposed variance, Mr. Bonvie suggested the applicant <br /> meet with the Fire Chief and discuss the situation regarding the road condition. <br /> Mr. Bonvie said; as one member of the Board, he would be in favor of the proposal if the <br /> Fire Chief is satisfied and submits a letter to the Board,and constitutes a plan that the Board <br /> agrees upon, and Counsel seeks a Variance. <br /> Mr. Gould agreed with Mr. Bonvie's comment, as well as Vice Chairman Bill Blaisdell, <br /> and Chairman Furbush, all agree with Mr. Bonvie's comment. <br /> Attorney Kirrane would like to continue the hearing until he has a conversation with Fire <br /> Chief Rullo. <br /> Mr. Bonvie made a motion to accept the applicant's request for an extension until April 11, <br /> 2018 for both the Variance and the Appeal. <br /> Mr. Gould seconded, yes, Mr. Furbush,yes,Mr. Blaisdell, yes, and Mr. DeBarros, yes. All <br /> were in favor of the continuance until April 11, 2018. <br /> 7 <br />
