Ray Balducci, a direct abutter, asked if the wall was going to be totally demolished and rebuilt and Mr . O ' Sullivan said this was correct and would be done with Mr. Balducci ' s permission . Mr . O ' Sullivan stated there would not be any machinery used on the Balducci land but there would be foot traffic . Mr . Balducci said he had no objections as long as it was done as planned . The Board requested an engineer ' s plan showing lot coverage . Mr. Friel moved to grant a 'variance on the Nide setbacks allowing a 3 ' side setback at the front and 5 ' at rear of garage pending receipt of new plan . Mr . Govoni seconded . All agreed . Frederic W . Blythe - Requests a Special Permit under Section 174-25 . 1 . 9 of the Zoning By-laws ,for permission to build a dock consisting of a pier, ramp and floats in an R-3 zoning district on property located at 228 Wading Place Road ( Map 119, Block 59 ) Mashpee, MA. Members sitting : M. Makunas, E . Govoni, J . Friel Attorney William Henchy represented the applicant and explained that an existing float would be replaced by a new ramp, dock and pier . He said Both Conservation and Shellfish Commissions suggested moving dock to deeper water. He said plans originally called for a boardwalk but it was removed after objections from an abutter, Mr. Reidy . He asked to refer the discussion to Mario DeGregorio of Sabatia, a shellfish expert and Roger Michniewicz, the engineer . Mr . Makunas noted that no objections had been received from Conservation or Shellfish . Mr . DeGregorio explained that the applicant has a mooring and wanted a sturdier structure of a 35 ' pier and four seasonal floats . He said they had taken soundings to show ledge where shellfish resources are located and said the harbormaster said it would not impede navigation in Popponesset Creek . He explained that they would be going to the state for a Chapter 91 license . Mr . Michniewicz said it was an 18 ' fixed pier with a 16 ' seasonal ramp and four floats . Myles McHugh, a neighbor, explained that he would be looking directly at the dock and this would detract from a view. Sam Ruo, an abutter, said he dial not consider the location appropriate since area had been used by children for play . Clifford Dallmeyer, an abutter, said his grandchildren played on the lot . He said he had a mooring and walked to his boat at low tide . He said the Blythe pier would be blocking his
