Friel asked Mr. Halpern how long a real estate office had <br /> been operated at the site and Mr. Halpern replied there had <br /> always been a desk and phone there . Mr. Halpern said there <br /> were display cases in the lobby and indian things were sold . <br /> Ms . Mills said she had questioned the real estate office . <br /> Ms . Mills suggested Ms . Neal be allowed to sell out of her <br /> home . Mr . Halpern said he thought the shop fit into the idea <br /> of having the coffee shop and restaurant and motel . He said <br /> this side of Mashpee needs revitalization . Mr. MakUnas asked <br /> if the Board had any question of its authority to grant the <br /> Special Permit . Mr. Friel said he did not question authority <br /> of the Board . Mr. Friel moved to grant the Special Permit . <br /> Mr . Govoni seconded . All agreed . <br /> Ms . Mills said she felt the Board owed her the courtesy of <br /> checking with Joe Reardon and was disappointed in the Board . <br /> Stephen Van Tol - Mr. Makunas noted that Mr. Van Tal , the <br /> landscape architect on the Design Review Committee, had <br /> arrived and asked if the landscaping on Little River Boatyard <br /> had been completed satisfactorily. Mr. Van Tol said he had <br /> done two on-site visits and he was satisfied today that the <br /> work had been completed as required . <br /> Louis Marandola - Requests a Special Permit under Section <br /> 174-25 . 1 . 13 of the Zoning By- laws for permission for the <br /> temporary sale of Christmas trees and wreaths in a C-1 zoning <br /> district on property located at 650 Falmouth Road (Map 81 , <br /> Block 4 ) Mashpee, MA. (Owner of record : Charles M. <br /> Talanian, TR ) . <br /> Members sitting : M . Makunas, E . Govoni, J . Friel <br /> Chris Marandola represented the applicant and said he was <br /> continuing the seasonal sale of trees . Mr. Friel moved to <br /> grant the request for a Special Permit . Mr. Govoni seconded . <br /> All agreed . <br /> Mr . Makunas said he would like a written decision from Town <br /> Counsel as to the authority in granting the Special Permit <br /> for a gift shop at Riverbend . Mr . Friel said he was opposed . <br /> He said the evidence is very clear that this is a <br /> pre-existing nonconforming use and currently has active <br /> retail uses in restaurant take-out . Mr. Friel said it was an <br /> appropriate use for the zone and is a lesser use than a real <br /> estate office . He said the discretion on non-conforming uses <br /> has to be left up to the Board and the Board should protect <br /> its rights in determining these matters . <br /> Mr . Makunas moved to adjourn at 8 : 40 P. M . Mr. Govoni <br /> seconded . All agreed . <br /> Elinor Walsh <br />
