Board of Appeals Minutes - October 23, 1991 2 .
Members present : W . Hanrahan, M . Makunas, C . Hawver,
E . Govoni
W. Burtis : We asked for a 90-day extension to do three or
four different things . When they gave me the
limit of 90 days to work through I questioned
that but I was told the 90 days was the amount
Of time I was going to have .
W. Hanrahan : By whom?
W . Burtis : By the Cape Cod Commission and when I came
before you after the Cape Cod Commission .
There were 15 conditions which we had to
comply with -- #1 was the size of the building
which we took 40 feet off of so that it
complies with what the conditions were .
W . Hanrahan : You ' re talking about the 15 conditions from
the Cape Cod Commission -- #1 is the size of
the building ,
W . Burtis : That ' s the same . . . it now complies with two
sections off . . . 132 feet long and 52 feet
wide . . . that ' s A . and B . on the plan .
M . Makunas : Mr . Chairman, may I make a suggestion? From
what I understand, the site was viewed by the
Building Department and inspected and rather
than go through each one of these maybe if we
get a statement from the Building Inspector as
to what conditions, just by number, have been
complied with and let ' s get down to the ones
that are in question as to whether they have
been complied with .
D• Boyd : The Cape Cod Commission conditions -- the
berm, the containment . . . .
W. Hanrahan : Can you reference them by number, Doug? Do
you have that in front of you?
D. Boyd : Condition #9 .
M . Makunas : Maybe if we just narrow it down to what the
items are that you consider open items and
then we can comment on each one of those ,
D . Boyd : #7 -- the outer facade and #8 . The reason I
mention these -- 7 and 8 -- and put them
together is because I feel a landscape bond
should have been posted since a landscape bond
offers the Town protection . If the work isn ' t
done the Town can pick up the bond and proceed
to do the work .
M . Makunas : What else?
W. Burtis : May I make a comment on that?
M. Makunas : Why don ' t we just list all of the items so
that we have an idea what we ' re working with .
Is it just #7 and #8 .
D . Boyd : No, I ' m starting there .
M. Makunas : Why don ' t you continue then so that we have an
idea exactly what the open items are .
