TOWN OF MASHPEE Board of Appeals Minutes February 13, 1991 The Mashpee Board of Appeals held a meeting at 7:30 P.M. on Wednesday, February 13, 1991 at the Mashpee Town Hall. Board members present and acting throughout were Cheryl A. Hawver, Chairman; Michael A. Makunas, Vice Chairman; and William J. Hanrahan, Clerk. Edward M. Govoni, Associate Member, was present for the discussion. Building Inspector Douglas S. Boyd .was in attendance. Chairman Hawver called the meeting to order at 7:46 P.M. Steven R. and Barbara Ball - Request a Variance under Sections 174-31 and 174-33 of the Zoning By-laws for permission to vary the lot frontage requirements and setback from wetlands on property located in an R-3 zoning district at 328 Red Brook Road (Map 109, Block 15) Mashpee, MA. Members sitting: C. Hawver, M. Makunas, W. Hanrahan Builder Moe Cassenelli represented Steven Ball. He reviewed plans showing house placement 32' from the wetlands and explained that this was the only possible location due to the topography. Mr. Hanrahan read a memo from Conservation stating they had no objection if land surrounding the construction were protected and planted with native shrubs. Elias McQuaid, Health Agent, said that the applicant had satisfied the Board of Health requirements. Mr. Hanrahan stated there was an obvious hardship due to the shape and topography of the lot. Mr. Makunas moved to grant the Variance as requested subject to Conservation approval. Mr. Hanrahan seconded. All agreed. Minutes - Mr. Makunas moved to accept minutes of January 23, 1991. Mr. Hanrahan seconded. All agreed. Discussion - Mr. Hanrahan asked for discussion since there were several people in the audience and he asked if they were here for the Little River Boatyard application. Mr. Makunas stated that there was a public hearing at the Cape Cod Commission an Monday, February 25, 1991 at 11 A.M. at the First District Courthouse in Barnstable. Wm. Henchy, attorney for abutter Virginia Driscoll, said he had understood there was consideration to withdraw the request for Jurisdictional Determination. Ms. Hawver said this was not the case and the public hearing before the Board of Appeals is suspended. Mr. Makunas said that the Cape Cod Commission would have to submit a written statement requesting withdrawal.
