TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> February 13, 1991 <br /> The Mashpee Board of Appeals held a meeting at 7:30 P.M. on <br /> Wednesday, February 13, 1991 at the Mashpee Town Hall. Board members <br /> present and acting throughout were Cheryl A. Hawver, Chairman; <br /> Michael A. Makunas, Vice Chairman; and William J. Hanrahan, Clerk. <br /> Edward M. Govoni, Associate Member, was present for the discussion. <br /> Building Inspector Douglas S. Boyd .was in attendance. <br /> Chairman Hawver called the meeting to order at 7:46 P.M. <br /> Steven R. and Barbara Ball - Request a Variance under Sections <br /> 174-31 and 174-33 of the Zoning By-laws for permission to vary the <br /> lot frontage requirements and setback from wetlands on property <br /> located in an R-3 zoning district at 328 Red Brook Road (Map 109, <br /> Block 15) Mashpee, MA. <br /> Members sitting: C. Hawver, M. Makunas, W. Hanrahan <br /> Builder Moe Cassenelli represented Steven Ball. He reviewed <br /> plans showing house placement 32' from the wetlands and explained <br /> that this was the only possible location due to the topography. <br /> Mr. Hanrahan read a memo from Conservation stating they had no <br /> objection if land surrounding the construction were protected <br /> and planted with native shrubs. <br /> Elias McQuaid, Health Agent, said that the applicant had <br /> satisfied the Board of Health requirements. <br /> Mr. Hanrahan stated there was an obvious hardship due to the <br /> shape and topography of the lot. Mr. Makunas moved to grant the <br /> Variance as requested subject to Conservation approval. Mr. Hanrahan <br /> seconded. All agreed. <br /> Minutes - Mr. Makunas moved to accept minutes of January 23, 1991. <br /> Mr. Hanrahan seconded. All agreed. <br /> Discussion - Mr. Hanrahan asked for discussion since there were <br /> several people in the audience and he asked if they were here for the <br /> Little River Boatyard application. Mr. Makunas stated that there was <br /> a public hearing at the Cape Cod Commission an Monday, February 25, 1991 <br /> at 11 A.M. at the First District Courthouse in Barnstable. <br /> Wm. Henchy, attorney for abutter Virginia Driscoll, said he had <br /> understood there was consideration to withdraw the request for <br /> Jurisdictional Determination. Ms. Hawver said this was not the case <br /> and the public hearing before the Board of Appeals is suspended. <br /> Mr. Makunas said that the Cape Cod Commission would have to submit <br /> a written statement requesting withdrawal. <br />
