TOWN OF MASHPEF <br /> Board of Appeals <br /> Minutes <br /> January 23, 2991 <br /> The Mashpee Board of Appeals held a meeting at 7 : 30 P. m. on <br /> Wednesday, January 23, 1991 at the Mashpee Town Hall . Board <br /> members present and acting throughout were : Cheryl A. Hawver, <br /> Michael A. Makunas, William J . Hanrahan, Edward M. Govoni, John J . <br /> Friel and B . Thomas Christian. Building Inspector Douglas S . Boyd <br /> was in attendance . <br /> Chairman Hawver called the meeting to order at 7 : 40 P. M. <br /> Little River Boatyard Inc . - Requests a Special Permit under <br /> Sections 174-3 and 174-25 .E.5 of the Zoning By-laws for the <br /> construction of an enclosed building for storage of boats on land <br /> in an R-3 zoning district on property located at 15 Riverside Road <br /> ( Map 119, Block 88 ) Mashpee, MA. (Owner of record : William E. <br /> Burtis ) . <br /> Members present : C. Hawver, M. Makunas, W. Hanrahan, E. <br /> Govoni, J . Friel, T. Christian <br /> Attorney John Connolly represented the applicant . Mr. <br /> Makunas asked permission of the Chairman to ask the Building <br /> Inspector if this structure is an auxiliary structure or a primary <br /> structure . Mr. Boyd responded that there were many questions on <br /> the definition and he did not have an opinion. <br /> Mr. Makunas asked Mr. Connolly if he had an opinion on the <br /> definition of the structure . Mr. Connolly replied that he <br /> believed it was a primary structure and an open-air commercial <br /> structure . He said he believed the application should be exempt <br /> from the Cape Cod Commission. He asked that the Board of Appeals <br /> apply to the Cape Cod Commission for a Jurisdictional <br /> Determination and should receive a reply in 21 days . <br /> Mr. Connolly informed the Board that he was going to apply to <br /> the Commission for a DRI Hardship Exemption. He explained that <br /> the issue of Cape Cod Commission review had been introduced by the <br /> attorney for abutters, John and Virginia Driscoll . He said that <br /> the original permit was issued before the existence of the Cape <br /> Cod Commission. Mr. Connolly said that they had tried to <br /> accommodate the objections of the Driscolls . He said the current <br /> application involves removing 40 ' of the building because of their <br /> objections and is now within the setbacks . <br />
