F <br /> i <br /> Board of Appeals Minutes - January 23, 1991 2. <br /> Mr. Makunas stated that the Board would consider this a new <br /> application for a structure. He said that the Board would refer- <br /> the application to the Cape Cod Commission for a Jurisdictional <br /> Determination. He said that the hearings will be suspended when <br /> the Application is sent to the Commission. <br /> Mr. Makunas moved to submit an application for Jurisdictional <br /> Determination to the Cape Cod Commission. Mr . Hanrahan seconded. <br /> All agreed. <br /> Ms. Hawver explained that the Board would take comments from <br /> those at the meeting. Dr. Stephen Ferry asked what was going to <br /> the Commission and Mr. Makunas said it was the current <br /> application. Mrs. Virginia Driscoll , an abutter~, asked if the <br /> hearing could be held open until her attorney could attend. Mr. <br /> Mak:Ltnas replied that the hearing is automatically held open <br /> pending the Determination. Mrs. K'ay Ferry, an abutter, asked for <br /> explanation of the procedures. Ms. Hawver said everything is on <br /> hold until the Cape Cod Commission decides who will handle the <br /> application. <br /> Elias McQuaid, Health Agent, said that the Board of Health <br /> concerns had not been met in previous decisions. <br /> Craig Johnston - Requests a Variance under Section 174--31 of <br /> the Zoning Cay-laws for permission to vary the lot size in an R-5 <br /> zoning district ,on property located at 17 Wilann Road (Map 46, <br /> Block 43) Mashpee, MA. (Owner of record: Craig and Patricia <br /> Johnston) . <br /> Members sitting: C. Hawver, M. Mak:unas, E. Govoni <br /> Mary Gilbert represented the applicants. She explained that <br /> most of the lots in neighborhood had been granted Variances under <br /> the Sunset Strip applications. The Board was familiar with the <br /> circumstances and Mr . Makunas explained that there had been zoning <br /> changes and a few lets had been excluded. The hardship was not <br /> self-imposed. <br /> Mr. Makunas moved to grant the Variance. Mr. Govoni <br /> seconded. All agreed. <br /> The Board reviewed decisions and correspondence. There was <br /> discussion of office procedures. <br /> Mr. Friel moved to approve the Annual Report. Mr. Govoni <br /> seconded. All agreed. <br /> Mr. Friel moved to accept the minutes of November 29, 1990 <br /> and Janizary 9, 1991 . Mr. Govoni seconded. All agreed. <br /> Mr. Hanrahan moved to adjourn at 8: 50 F. M. Mr. Govoni <br /> seconded. All agreed. <br /> Elinor Walsh <br />
