Mashpee Public Schools not be adversely impacted by the Consolidation; <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> 1. Oreanizational Structure <br /> The Town and the District hereby acknowledge and agree that, for the purpose of <br /> implementing the Consolidation plan adopted by the Town of Mashpee, the following <br /> organizational structure shall be applied: <br /> 1 The Town shall employ a Facilities Supervisor who shall supervise all Building <br /> Maintenance and Grounds employees responsible for District buildings and <br /> grounds (hereinafter, "BMG staff'). The current BMG staff that have <br /> responsibility for District buildings and grounds are identified by name and job <br /> description in Addendum 'A' attached hereto. The Superintendent and the <br /> Facilities Supervisor shall jointly discuss and agree upon any modifications to the <br /> standard of work to be provided by any current or future member of the BMG <br /> staff who has responsibility for District buildings and grounds. Any changes to <br /> these job descriptions shall be subject to collective bargaining, as applicable, and <br /> shall be incorporated by the Town into any collective bargaining Memorandum <br /> with the BMG staff upon negotiation and mutual approval by the bargaining unit <br /> and the Town. <br /> 2 The Facilities Supervisor shall report directly to the Public Works Director for the <br /> Town. Notwithstanding the reporting structure referenced by the preceding <br /> sentence, it is hereby agreed and acknowledged that a school building Principal <br /> and/or the Superintendent shall have the right to request that the Facilities <br /> Supervisor instruct any BMG staff or School Custodial staff member to take or <br /> refrain from any action for the purpose of complying with District policies and/or <br /> meeting the obligations of the Town pursuant to this Memorandum of <br /> Understanding. Further, each school building Principal and the Superintendent <br /> shall have the right to contact the Facilities Supervisor and/or the DPW Director <br /> to address any concerns, request information, and to discuss any other matters that <br /> may arise related to the operations of the District buildings and grounds. In the <br /> event that the District is not satisfied with the response of the Facilities Supervisor <br /> and/or the DPW Director to any request or concern, the Superintendent shall meet <br /> with the Town Manager, or his/her designee, within five (S) calendar days of the <br /> request, or earlier if necessitated by safety concerns, to discuss the issue. <br /> 3 The Superintendent shall have the right to submit a written evaluation of the <br /> Facilities Supervisor's performance with respect to District buildings and grounds. <br /> 4 In an effort to minimize any disruption or inconvenience for School teachers, staff <br /> and students, the Department of Public Works shall consult in advance with the <br /> Superintendent for the purpose of scheduling any non-emergency work to be done <br /> on any District buildings or grounds by BMG staff.
