Chairman'matt distributed a copy of a letter dated May 8, 1998,to Ms. Jane Labute, Town Clerk of Mashpee,from Attorneys At Law,I o elman and Paige,regarding theBy-Law - and their opinion as to whetherBy-Law 5-8 prohibits a'Town Fire Fighter fxom being elected to the Finance Committee. Chairman Watt noted that there is a provision in the -laws that the Finance Committee shall consist of seven voters at a time,none of whom shall hold any other elective or appointed town office, except as otherwise authorized in this code. There was question as to what is meant by"town office"and whether a town employee is considered employed by "town office." It was noted that in the letter from Attorneys At Law,I opelman and Paige,to Il ashpce Town Clerk,that in their opinion,By-Law 5-8 does prohibit a member ofthe'down Fire Department from serving on the Finance Committee. It further states that such a person should be aware that in the event that he is elected, he would be required to resign from his other Town office in order to serve on the Finance Committee. Mr. Golub noted that this issue is not a Finance Committee opinion. He noted that the Finance Coru-nittee serves the Town and the Town makes the rules as to who can and who should serge on the Finance Committee. Mr. Cashman noted that he has not received any written notice from the Town informing him that he has to resign from his position with the Finance Committee or from the Tire Department. Ilr.Kumin stated that it should be noted that there could be a problem if Mr. Cashman voted on Finance Committee issues and it turns out that he should not be on the Finance Committee in that his vote may be invalid, It was suggested that Mr. Cashman abstain from noting on any issues at the present meeting. It was also suggested that Mr. Cashman not attend any Finance Committee Executive Sessions. Mr. Golub suggested that a letter be written to the Town Clerk and ask her for a definitive direction on the issues with Mr. Cashman. RE UEST FOR TRANSFER TO UNEMPLOYMENT ACCOUNT: Chairman Watt informed the Finance Committee that he received a Request for Transfer From The Reserve Fund. The Request for Transfer was received from the Treasurer for the amount of$1, 00 to be transferred to the Unemployment Account. The Treasurer noted on the bequest for Transfer that she had requested$10,000 in her fiscal 1998 budget.and$5,000 was recommended. At the present,there is$.07 in the appropriation and$579.45 in the bank amount. She noted that she has a current bill for$608.00 with one mors month to go. Chairman Watt stated that he was informed by Anne Shaw, Treasurer,that this expense was clue to one employee. Motion to Approve equ st for Transfer: Mr. Golub made a motion to approve the Request for Transfer for the amount of$1,000.00 to be transferred to the Unemployment Account.
