He reviewed the mitigation plan. <br /> Mr. Costa, on behalf of the applicant, requested a waiver. He stated the garage is moderately <br /> compelling due to the unique shape of the property. The degree of variance from the standards <br /> is minor because the proposed structure will be located In a legally previously disturbed area <br /> and the coastal bank is armored and not a sediment source. The mitigation is major due to the <br /> long term mitigating measures which exceeds the requirements resulting in an increased habitat <br /> area. He stated the proposed project has been properly balanced and meets the waiver <br /> requirements. <br /> The Agent noted there was debris on the site that the homeowner will have to remove. He <br /> noted the Board of Health comments. The application was submitted and under review for a <br /> conventional Title V leaching facility. The Agent questioned the removal of the trees. He asked <br /> about the trees that were outside of the footprint of the garage. Mr. costa felt they will be <br /> impacted by the construction but will make an effort to save a couple of the trees, The Agent <br /> suggested conditioning that wood board strapping protect the trees and if they are damaged the <br /> Commission be notified ahead of time before their removal because they are very close to the <br /> coastal bank. <br /> No comments from the public <br /> Lotion: Mr. Sweet moved to close and issue with the conditions outlined by the Agent, <br /> seconded by lir!
