The degree of variance from the standards is minor because the proposed structure will be located In a legally previously disturbed area and the coastal bank is armored and not a sediment source. The mitigation is major due to the long term mitigating measures which exceeds the requirements resulting in an increased habitat area. He stated the proposed project has been properly balanced and meets the waiver requirements. The Agent noted there was debris on the site that the homeowner will have to remove. He noted the Board of Health comments. The application was submitted and under review for a conventional Title V leaching facility. The Agent questioned the removal of the trees. He asked about the trees that were outside of the footprint of the garage. Mr. costa felt they will be impacted by the construction but will make an effort to save a couple of the trees, The Agent suggested conditioning that wood board strapping protect the trees and if they are damaged the Commission be notified ahead of time before their removal because they are very close to the coastal bank.
