Fudala <br /> expressed concern that there is no zoning proposal at this point . <br /> He suggested placing a sense of Town Meeting Article on the <br /> Warrant to determine support, as oppos d to the details of a <br /> specific zoning bylaw. <br /> Mr. Storrs r mentioned Copies of the Cape Cod Commission <br /> Model zoning Ordinance and the Town Planner' s Flexible Commercial <br /> Zoning ordinance were provided to the Committee in November and <br /> input was requested at that time. To date, there has been no <br /> response. <br /> it was decided that Mashpee Commons Ltd. Partnership would <br /> provide a draft proposal on zoning operating system) for the <br /> next scheduled Meeting. <br /> Selectman Dini io asked Sharon Rooney of the Cape Cod <br /> commission if the Town would be able to negotiate impact fees <br /> with the Developer if the Local Comprehensive Plan LC is not in <br /> place. <br /> Sharon Rooney replied, "No, not technically. " She stated <br /> that a Certified LCP would have to be in place in order to assess <br /> impact fees . <br /> ashpee Commons Ltd. Partnership agreed to become party to <br /> a binding document whereby impact fees mai' be imposed after the <br /> LCP is legally in place. <br /> Selectman Dinizio clarified this concern would be addressed <br /> in order for Mashpee Commons Ltd. Partnership to move forward., as <br /> well as preserving the Committee' s ability to protect taxpayers <br /> from development expenses incurred. <br /> At this point there was discussion as to the process for <br /> filing Town Meeting Articles on the Warrant. ) <br />
