Discussion-OSID Bylaw <br /> The Chairman requested a brief synopsis from the Town <br /> Planner~ regarding the OSID Bylaw. <br /> Mrr.. Fudala explained the o ID Bylaw was adopted in 1986, <br /> replacing the Bylaw under which all of the condominium projects <br /> had been constructed. The OSID Bylaw allows for multiple parcels <br /> to be scattered around Town; the development rights can be moved <br /> to a location considered to be more appropriate by the Town. <br /> There is a snap in existence which designates "primary" and <br /> "secondary" conser ation areas <br /> Mr. Fudala also explained there now exists a minimum of <br /> fifty o percent of the total amount of land that must be <br /> designated as open space. <br /> Mr. Fudala stated the bonus multipliers are based upon <br /> whether the land is located in primary or secondary conservation <br /> areas. Another bonus multiplier is based upon laud value <br /> waterfront property, salt waterfront, fresh water riverfront, <br /> pond front) . The third bonus multiplier relates to the owner of <br /> the open space, public access. A final bonus multiplier was <br /> added in 1990 relating to whether or not the developed portion of <br /> the project is going to be connected to a waste water treatment <br /> plant, <br /> Mr. Fudala explained the Bylaw is fairly lengthy due to the <br /> fact it contains a lot of description regarding how the <br /> development is constructed. He stated the Bylaw does not contain <br /> a lot of design standards; basic Special Permit design <br /> requirements had to be adopted. <br /> Mr. Fudala stated the old Bylaw restricted development to <br /> two 2 bedroom units, or a very few at three ( when a unit <br /> is moved, it is not considered to have an unlimited number of <br /> bedrooms, it is treated as a 2 .2 bedroom house. <br /> Mr. Fudala explained a number of amendments had been rade in <br /> 1990, one of which would allow the developer to total the unit <br /> counts and tape one and one half 1 12 units worth of housing <br /> and turn it into a single-family lot with no bedroom <br /> restrictions. He mentioned that this particular clause within <br /> the Bylaw would probably be applied to theWhiting' s Road area <br /> where lots can be created without being concerned with the <br /> bedroom count . <br /> Mr. Fudala further explained there is currently two 2 acre <br /> zoning atWhiting' s Road. The decision would be left to the <br /> developer to decide how many units are to be brought in from <br /> other properties around Town. He also reminded Conunittee Members <br /> that all of this would be done under Special Permit from the <br /> Planning Board, all requirements of the Zoning Bylaw will have to <br />
