He asked Mr. Lopes: If these are family dogs, why do they have to <br /> be caged in Mr. Lopes said it has never been an issue and where they are right now the yard is not <br /> fenced in. Mr. Lopes said they're putting fence for protection for him so as not to get sued. Mr. <br /> Lopes added that he had the dogs over 9 years and never had an issue with the neighbors. <br /> Chief Collins asked where the dogs were housed over the g years. Mr. Lopes said in Falmouth for <br /> years; and in Mashpee on 130 for 4 or,5 years. <br /> Ernie Barrows, 201 Ashurnet Road <br /> 1r. Barrows said he has witnessed dog attacks...4 attacks were by rottweilers. He said he's had <br /> dogs corner people on his property. He said these are bad, but pit bulls are gorse. Mr. Barrows <br /> asked: If they are such good pets why aren't they in your house? Mr. Lopes responded: Because he <br /> has 6 of therm and they are messy. He said he has one in the house at a time...he alternates therm so <br /> they take turas in the house. Mr. Barrows said he doesn't think a pit bull should be in that <br /> neighborhood. <br /> Ken Dan elo 134 Ashumet Road <br /> Mr. Dangelo said he was the one attacked while walking a dog. Definitely pit bulls are most <br /> aggressive and don't belong in residential neighborhood. <br /> Continuance of Hea ' n <br /> Chief Collins addressed the Hearing saying that further follow-up is needed to be done by animal <br /> control; by Board of Health; relationship to Heritage Park; and official research to be sure of past <br /> history of these dogs; etc. Chief Collins said he is not sure public safety issues can be satisfied. Toni <br /> Fudala said unless we get written request from Applicant for extension to continue Hearing, then vire <br /> have to do one of four things—namely 1 Approve; 2 Approve with conditions; 3 Deny for <br /> specified reasons; or Determine that additional information is required. <br /> Both Tiffany Mendes and Brendan Lopes said they were willing to request a'continuance of the <br /> Hearing for 60 days. Tiffany Mendes prepared a handwritten request; she and Mr. Lope.s signed the <br /> request; and it was handed to Rich Stevens. Rich Steven read aloud the request for continuance of <br /> Hearing. A copy of this document is attached to the printed set of these minutes. <br /> Motion: Torte Fudala motioned that we should continue this Hearing to 9 a.m.,, Thursday, April <br /> 23, 2009; Ronnie Warden en seconded this motion; and it was unanimously passed. <br /> Conclusions <br /> Catherine Laurent asked how ,much longer the dogs will be at the 130 location. Ronnie Warden said <br /> since Mr. Lopes was going to ,move at the end of March it was decided to go this route and apply for <br /> the permit at the new location. Tom Fudala said after the town meeting changed the by-lav they've <br /> been getting the people to come in and this is one of the last ones. Catherine said then between <br /> today and 60 days we have 6 dogs being kenneled at a location without any oversight and they're not <br /> fenced in It was again mentioned than this Committee has no jurisdiction, except to act on the <br /> permit. <br /> 4 <br />
