Biddin .Results—Attached please find the tabulation of GC bid results. After the bid openings the Cornrnittee voted to accept Alternates 1 (Cupola) and 2 (Wood Trellis) and not go for-ward with Alternate 3 (Limestone in leau of manufactured cast stone units). The lowest bidder with Alternates I and 2 is Bufftree Building Company, Inc out of New Bedford, IIIA with a bid price (including Alts I and 2) of$6,402,800.00. The bid percentage spread-between the first bidders was$49,200.00 or less than 1.00°x. This is a very low percentage spread and reflective on the quality of the documents. . bidder Bid Form and DCAM Checks—PA performed a thorough review ofthe bid forms and DCAM files for the folilowidg low bidders. General Contractor,Masonry}Waterproofing, lumbing,Fire Protection,HVAC and Electrical.PA did not perform DCAM file reviews for Mise Ketals,Roofing and Flashing,Tile,Acoustical Tile, Resilient Flooring,Painting and Elevators. -GC apmre ,-- AM fie was reviewed and appears to very good. Avg rating�- . The bid form appears to be complete and in order,However It should be noted that; 1. Buff ree had a clerical error on its bid form in the sense that they haat recorded the Plumbing - Filed-Sub and price in the Fire Protection line of the bid form and the Fire Protection Filed-Sub and price in the Plumbing ae. The error does not change the bid price. I have reviewed this issue with Brian O onnell at the AC's office{Bid protest Division)and he has agreed that the clerical error is aterial and can be accepted.f have also requested and received a letter from - Bufftree stating that the error does not affect their bid prig.And; 2. - The bid price Buffiree inserted for.Add Alternate#1 was less than the accumulative total of the effected Filed-Sub Bidders bid prices for the same Add Alternate #I.Add Alternate#1 included work to be performed by the GC,Roofer and Painter. The bid Prices which were submitted by the Filed-Sub Roofer and Painter which Buffiree carved totaled $16,500.00. The total prig which Buffiree bid for this alternate was $13,600.00 which is less. PA was contacted by the i second lowest bidder (Groom) and Groom claianed that the procedure was against the law and Bufftree's Alternate ##I prig must be at least the total of the Field-Sub Bids. I reviewed this matter with Brian O'Donnell at the AG"s office(Bid protest Division).Brian has researched the issue and has determined that Buff ree's bid is valid and the GC can quote any amount for the alternate*but is obligated to contract with the Filed-Sub for the Filed-Subs bid amount including Filed-Sub's hid alternate amount. Bruit has also provided evidence of a Superior Court finding substantiating this decision.I have attached this decision for your information.
