"Workshop" Session: Rental Property Regulation and Warrant Article for Town Meeting <br /> Approval. <br /> Brian Baumgaertel stated that the Board will be discussing a new regulation for rental properties. This is a <br /> workshop only. There will be no votes taken this evening. <br /> Glen Harrington commented that he incorporated the Falmouth, Barnstable, and Brovinceto n regulations into <br /> the draft of the rental property regulation for Mashpee, <br /> PURPOSE: <br /> This was simulated from the Barnstable regulation. <br /> AUTHORITY: <br /> This was also taken from the Barnstable regulation. Massachusetts General Law chapter 140, Section 32B is <br /> the same regulation that oversees motels and manufactured homes} chapter 111, Section 31 is the home rule <br /> which allows the Board of Health to make reasonable regulations} and Chapter 111, Section 127A is also <br /> another continuation of Section 31 where the Board of Health has the right to create regulations. <br /> Brian Baumgaertel suggested using semi-colons since there are many commas within the regulation. It would <br /> be less confusing, <br /> DEFINITIONS: <br /> These were adopted from the Barnstable regulations. The definition of rental property was added since one <br /> vvas not included in the Barnstable regulation. The rental property definition describes when and ghat time <br /> periods. It would include yearly, monthly, weekly and daily rentals. <br /> LICENSED FACILITY: <br /> Any facility licensed under state or town control are exempted from the fees. <br /> RESPONSIBILITY of NOTIFICATION: <br /> This is more of a notice informing the occupants of the rental regulation and the noise by-lave. This section can <br /> be eliminated by stating on the actual certificate, which will be posted in the unit, that there Is a regulation <br /> overseeing the rental unit and also to include the noise by-law on the permit. Smoke detectors and carbon <br /> monoxide detectors should also be referenced on the permit. <br /> CERTIFICATE of REGISTRATION: <br /> 1 <br />
