No person shall rent or lease or offer to rent or lease, any dwelling or portion of a dwelling to be used for <br /> human habitation without fiat registering with the Board of Health for a rental certificate. The Board of Health <br /> shall determine the number of bedrooms and the number of persons such dwelling or portion of a dwelling that <br /> may lawfully accommodate under the provisions of any state or local health and safety by-law or regulation. <br /> The Board of Health shall, pursuant to the above subsection, issue a rental certificate which shall be renewed <br /> on the following December 31, provided that the certificate may be renewed each year. <br /> Under Conditions and Terms of the Provincetown regulation, Mr. Harrington borrowed the following: <br /> Rental certificates shall be issued subject to such conditions as the Board of Health deems necessary for the <br /> protection of the public health, safety and welfare. <br /> The Board of Health shall determine the number of bedrooms, and it should be indicated on the certificate. <br /> Mr. Harrington will request a copy of the floor plans, if not already on file with the Board of Health, labeling the <br /> rooms and the size of the rooms. This will confirm the information provided by the owner. <br /> Brian Baumgaertel suggested keeping the language the same and use the verbiage "rental certificate}' <br /> throughout the document. <br /> APPLICATION FOR RENTAL CERTIFICATE: <br /> This section will foliow the certificate of Registration segment. An owner is requested to provide the Board of <br /> Health with a rental application with his/her current residential address and telephone number. If the owner is a <br /> corporation, the name} address and telephone number of the president and legal representative of the <br /> corporation must be provided. If the owner is a realty trust or partnership, the name, address and telephone <br /> number of the managing trustee or partner shall be provided. In the event that the owner does not reside in the <br /> Commonwealth of Massachusetts, the owner shall designate one or more responsible individuals who can be <br /> reached and who shall be available at all times 24 hours a day 7 days a week to respond to emergencies and <br /> requests for assistance from tenants and/or Board of Health staff within one hour of being called. The name, <br /> address and telephone number of the responsible individual(s) so designated shall be provided on the <br /> application. <br /> The rental certificate shall specify name and contact information of the person responsible responding to <br /> emergencies. <br /> An up-to-date floor plan shall be required, if not on file at the Board of Health, to determine the number of <br /> dwelling units, rooms in each unit} and the size of each unit shall be shown. This needs must be submitted with <br /> the application. <br /> The application shall include a certification by the owner or its authorized agent, under pains and penalties of <br /> perjury, that they have inspected each unit and it complies with'all applicable lags, including but not limited to <br /> the State Sanitary code} State Building code, and the Town of Mashpee Zoning By-Laws. The Zoning By- <br /> Laws present a problem since it is limited and not more than two rooms can be rented. This by-law will need to <br /> be updated in order to conform to the rental regulation. <br /> Another addition to the regulation would be if food is planned to be served, it must comply with the state food <br /> code and the federal food code; although a continental breakfast is allowed. <br /> Falmouth has a description of the lead requirements, smoke detectors, septic system, and other items listed on <br /> the application. The noise by-law, carbon monoxide detectors, and serving of food should also be included. <br /> POSTING of RENTAL CERTIFICATE: <br /> No person shall rent or lease or offer to rent or lease} any dwelling or any portion of a dwelling to be used for <br /> human habitation without first conspicuously posting within such dwelling or portion of a dwelling a rental <br /> certificate provided by the Board of Health specifying the number of bedrooms and the number of persons <br /> such dwelling or portion of a dwelling may lawfully'accornmodate. <br /> KEEPING of REGISTER: <br /> 2 <br />
