7
Mallory Langler made a motion that the Board of Health add 47#Hernlock Drive to the agenda. Laurel Almquist
seconded the motion. The motion was unanimously approved.
Glen Harrington stated that this is time sensitive where the care of the occupant at 47 Hemlock Drive would be
better served if he remains in a long-term care facility rather than returning to a home that is in very poor
condition. His health has failed to the point that staying in the home would be a detrim6nt to his health. Elder
Services and protective services have been involved, but the occupant refused their help. In August 2017, Mr.
Harrington visited the property and spoke with the occupant. The occupant has a had relationship with his
family and will not allow them into his home. He requires daily care and dialysis. Long-term care would improve
his quality of life.
Mr. Harrington would like to discuss this issue with the Town Manager to make him aware of it and perhaps get
assistance with the constitutionality of it. obtaining an administrative warrant-from the court to have.entry into
the home is required in order to condemn the property.
There is no evidence that the mutters have been affected. This is merely the occupant's health that is of
concern, Action has been taken in similar cases where occupants have been removed from their homes. This
occupant refused Mr. Harrington access-to enter into the house. With the administrative warrant Mr. Harrington
can inspect the interior of the dwelling for entry of animals. This needs to be accomplished while the occupant
is still in long-term care.
Laurel Almquist made a motion that the Board of Health require an i nsppction at 47 Hemlock Drive to
determine the habitability of the dwelling and for the Health Agent to obtain an administrative warrant from the
court to do so. Mallory Langler seconded the motion. The motion was unanimously approved.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Thursday, February 15, 2018, at 7:00 PM.
