w f <br /> s' <br /> Mallory Langler made a motion that the Board of Health require the septic system be installed at 4 Tri-Town <br /> Circle within 30 days of the Health Agent's final approval of the septic plans. The reduction of bedrooms should <br /> also meet that same timeline of 30 days after the Health Agent's final approval of the septic system. The <br /> outstanding fines be reduced to $2,500, pending the fact that these timelines are met. If these requirements <br /> are not met, the fines will revert back to the original amount of$9,400. A deed restriction is to be placed on the <br /> property limiting the house to a three-bedroom home. <br /> Mallory Langler amended the motion that the Board of Health remove the deed restriction and add the <br /> requirement that floor plans be submitted to the Health Department along with the building permit. Laurel <br /> Almquist seconded the motion. The motion was unanimously approved. <br /> NEW BUSINESS <br /> 1 sign Expense Warrants. The Board members signed the expense warrants. <br /> 2. variance Request to cesspool Regulation and Enforceable Agreement: 104 Degrass Road. <br /> Glen Harrington.stated that the current owner, Sturtevant & Hook, Inc., has submitted a request for a variance <br /> to sell the property at 104 Degrass Road without upgrading the existing cesspools in lieu of the requirements of <br /> the Cesspool Regulation. The buyer,-Michael Ronhock, is in attendance tonight to discuss the conditions of the <br /> enforceable agreement that will mitigate the variance. The Purchase & Bale agreement has been provided, <br /> and ## o of the agreement states that the buyer is responsible for the upgrade of the septic system. The buyer <br /> is hot planning to-occupy the dwelling until the rendvation has been completed. <br /> Glen Harrington suggested that since the dwelling will not be occupied a condemnation of the property would <br /> protect that no one will be living in the horse. once the Certificate of compliance is issued for the septic and <br /> the certificate of Occupancy is granted, it will eliminate the condemnation. <br /> Laurel Airnquist made a motion that the Board of Health approve the variance at 104 Degrass Road with the <br /> condition of having Mr. Michael Ronhock, the buyer, enter into an enforceable agreement within seven days <br /> after-receipt of the Board's notice. With the property not inhabited, it will equal the issue of condemnation. The <br /> Certificate of occupancy will eliminate the condemnation, and repair of the septic systems must be completed <br /> prior to the issuance of the Certificate of Occupancy. Mallory Langler seconded the motion. The motion was <br /> unanimously approved. <br /> . Draft Dental Property Regulation. <br /> Glen Harrington commented that he will prepare the Articles for the Rental Property Regulation for the May <br /> Town Meeting which are due by-February 12, 2018. Mr. Harrington will be meeting'with the Town Manager on <br /> February 6, 2018, to discuss the creation of a new position and the presentation in the warrants. This requires <br /> a special Article for the funding and for the position. After his meeting with the Town Manager, Mr. Harrington <br /> wi�1 forward the draft rental property regulation to Sang Houghton at the Enterprise to write a story so that the <br /> public understands the Board of Health's position. Mr. Harrington expects opposition because many of the <br /> rental properties are not up to code. <br /> Changes from the last meeting were made, and a revised-copy was presented the Board. lir. Harrington would <br /> like to add traffic situations to the rental application" along with requirements for lead, smoke detectors, carbon <br /> monoxide detectors, septic system, noise by-law, food., and trash removal. <br /> The Board and Mr. Harrington discussed the daft rental property regulation. They examined the certificate and <br /> the advisory posting and adjusted the language. Refuse was also considered. Floor plans are required to be <br /> submitted, and bedrooms beyond the permitted amount will be required to have a 6-foot opening to eliminate <br /> privacy, which is the Board of Health requirement for the bedroom definition. Properties with too many <br /> bedrooms will be brought before the Board to remove the extra bed rooms. <br /> ADDITIONAL TOPICS <br /> 1. 47 Hemlock Drive. <br />
