MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 9, 2018 <br /> Board Member Scott Goldstein read the Board of Health Comments into the record; "BOH <br /> Comments: A septic inspection is required due to change of,faotprint (or addition of <br /> garage which will take up additional land for possible septic use). The septic inspection <br /> report shall be provided to the BOHprior to Building Permit approval. " <br /> Mr. Bonvie read the Board of Health comments that were emailed to the Building <br /> Commissioner into the record. "After our discussion with the owner of the above property, <br /> I wanted to memorialize the outcome in writing. After further review of the site plan, the <br /> front setback of 40' does not allow the garage to be put on the east side of the septic <br /> system. Therefore, the proposed location is really the only location that meets the septic <br /> setbacks to the pump chamber and the septic tank. The garage might be able to be moved <br /> laterally toward the septic tank but it will not gain any further distance from the real- <br /> property <br /> earproperty line. " <br /> Mr. Bonvie read the Conservation comments into the record. "I confirmed that there is a <br /> wetland situated on the lot at 50 Canonchet Avenue, and is very likely that the 100ft buffer <br /> zone to the wetlands extends onto the property at 56 Canonchet. " <br /> Mr.Bonvie asked the applicants if they filed anything with Conservation. Mr.Diggins said; <br /> he was not instructed to. He told them they needs to speak with Drew directly per his <br /> comments submitted; "This property lies within the 100 ft. buffer zone to a verified <br /> freshwater wetland. The applicants meet with conservation dept. staff to determine what <br /> type of filing is necessary for the garage, depending on location of said garage. " <br /> Mr. Goldstein read an abutter letter that resides at 9 Wamsutta Rd. into the record. <br /> Mr. Bonvie read a direct abutter to the property into the record. <br /> Mr. Furbush read an abutter letter that resides at 40 Canonchet Rd. into the record. <br /> The homeowners stated that they will not be running a business out of their garage. The <br /> water that runs in front of their home is runoff from Oneida, and they have been <br /> maintaining and preventing the runoff since they owned the home. The garage will be 25' <br /> x 25'. They are fencing in the entire backyard to avoid any issues. <br /> Mr. Furbush mentioned that all water must be contained on the property, and usually done <br /> with drywells. If there's an issue with your property, the Conservation Agent will make <br /> that determination. <br /> Mr. Goldstein mentioned that he needed clarity regarding the location of the garage in <br /> relation to the septic system. He said as one member, he does not have an issue. He said <br /> that Conservation has to approve this, but the Board can be made a condition in the <br /> decision. <br /> 2 <br />
