Smith_Mashpee_She[.lf...ish Aquaculture License„Application Hearing/review. NOTE:This will be
reviewed at 9:15AM.
Tom and Nick Smith presented their application for their shellfish Aquaculture License to the
Commission. There was a great deal of history reviewed by Al Turner and Brian Everett
regarding mistakes made early in this process by the Smiths. Al expressed his concern going
forward that laws and procedures must be followed to avoid future problems.
Nick Smith requested that the ramp/dock/Upweller Float be removed from their project. They
would reapply in a year(after starting their new venture)to apply for a modification of their
permit to include this upweller/dock piece for their project at their shown house location. A
written request/notification of removal should follow.
We discussed the mooring float in the grant track area. Nick advised he had approval from the
abutter who was assigned that mooring location both approval for the project and for the
Harbormaster to relocate the mooring somewhere near the present location. Mr. Bates asked
to see the approval letter. Nick said they would make sure they get one for their file.
Mr. Bates asked if they were aware of any conflict with Widgeon Grass in the grant track area
and if they had a certified letter from an appropriate qualified surveyor stating same. They did
not know of any grass in their area. Mr. Bates noted that it was his understanding Widgeon
grass was apparently a reason for a permit refusal by DEP on an area aquaculture project in the
past.
After reviewing the process leading up to today, the Commission voted unanimous approval in
favor to recommend the Parcel B location portion of the project. Motion in favor of the project
was made by Don MacDonald and seconded by Al Wickel.
Adiournment at 11:12 AM Motion to adjourn by Tim Leedham and seconded by Al Wickel
Next meeting May 8,2018 9:00 AM Popponesset Meeting Room
