w HOARD of APPEALS Minutes April 27 , 1994 The Mashpee Board of Appeals held a meeting at 7 : 30 P .3 . on Wednesday, April 27 , 1994 at the Mashpee Town Hall , Board Members present and acting throughout were Michael A. Makunas , Edward M. Govoni and James E. Regan III , Associate Member Cheryl A. Hawver was present for the Bayport and Hendler hearings . Building inspector William F. Hauck was In attendance . Leno Mendes and Ken Marstersr applicants for the Hoard Associate Members, were also present . Bayport Domes - (Advisement from March 9 , 1994 ) . Bayport Homes requests a Variance from Section 174-31 of the Zoning By-laws for permission to vary the front yard setback requirements in an R-5 zoning district on property located t 53 Tobisset St . (Map 3 , Block 23 ) Mashpee, MA. (owner of record: Peco Inc , ) Members sitting: M, Makunas, E. Govoni, C. Hawver Builder Craig Weedon submitted elevations of the proposed home and a landscape plan. He explained that the Conservation Commission has restricted types of plants which can be used and has prohibited any lawn. He said that copies of the plans have been delivered to the abutters . Mr , Govoni mooted to grant than Variance. M . Hawver seconded. All agreed. Hobert C, and Auta P, Hendl r - (From March 9 and April 1 meetings . Members sitting: M. Makunas, E. Govoni, C. Hawver Ms . Hawver explained that the motion to grant on April 13, 1994 had not included the condition that the dock be limited to boat size no larger than 17 foot . Ms . Hawver moved to add to the Special Permit Decision that the dock be limited to boats no larger than 17 feet. Mr. Govoni seconded. All agreed, Kenneth S, Sa Requests a Special Permit under Section 174- 1 .D and 174-55 .B of the Zoning By-laws to allow Stop Shop signage to exceed 20 square feet. Signs are proposed for the front and side of the building and nine departmental signs on property located in a -2 zoning district at 39 Nathan Ellis Highway (Map 74, Block 22 ) Mashpee, MA.
