8. <br /> 5 . Failure of an applicant to pay a consultant ' s fee shall <br /> be grounds for the denial of the Special Permit/Variance . <br /> 6 . At the completion of the Board ' s review of a project, <br /> any excess amount in the account, including interest, <br /> attributable to a specific project, shall be repaid to the <br /> applicant or the applicant ' s successor in interest . For the <br /> purpose of this regulation, any person or entity claiming to be <br /> an applicant ' s successor in interest shall provide the Board with <br /> documentation establishing such succession in interest . <br /> i 7 . Any applicant may take an administrative appeal from <br /> the selection of the outside consultant to the Board of Selectmen <br /> i within 14 days of notice of the selection. The grounds for such <br /> an appeal shall be limited to claims that the consultant selected <br /> has a conflict of interest or does not possess the minimum <br /> required qualifications . The minimum qualifications shall <br /> consist either of an educational degree in or related to the <br /> field at issue or three or more years of practice in the field at <br /> issue or a related field . <br /> 8 . The required time limit for action under an application <br /> by the Board shall be extended by the duration of the <br /> administrative appeal . In the event that no decision is made by <br /> the Board of Selectmen within one month following the filing of <br /> the appeal , the selection made by the Board shall stand . <br /> ABUTTERS ' LISTS <br /> Massachusetts General Laws require that abutters and <br /> abutters to the abutters within 300 feet of the property line be <br /> notified of the Public Hearing on all Applications . The <br /> Applicant is not responsible for the preparation of this list . <br /> The Mashpee Assessor ' s office will prepare the certified list of <br /> abutters and the Board of Appeals office will process the <br /> mailing . If abutters are located in adjoining Towns it is the <br /> responsibility of the Applicant to obtain a certified list of <br /> those abutters . <br /> A charge of $2 . 00 per abutter name will be billed to the <br /> Applicant for computer time, postage and supplies . <br /> PUBLIC HEARINGS <br /> A Public Hearing will be scheduled within 30 days from the <br /> date the Application was filed with the Town Clerk . <br />
