Board of Appeals Minutes - May 25, 1994 3 . <br /> Attorney Michael Ford informed the Board that the houses on <br /> this 5 . 40 lot predated zoning and subdivision control in <br /> Ma,shpee . The owner is seeking to reconstruct one of the <br /> cottages and upgrade the septic system. The altered house <br /> will meet the setbacks . He explained that Section 174-12 of <br /> the Mashpee codestates - that there shall not be more than 4 <br /> one principal building on any residential lot but this was <br /> enacted 40 years after the properties existed on the lot . <br /> Mr . Ford stated that the non-conformity was created because <br /> of the three houses on the lot . <br /> Mr , Friel moved to grant the Special Permit . Mr . Govoni <br /> seconded. All agreed . <br /> Discussion - Dr . Petti . <br /> J . Regan stepped down from the Board for the Discussion * <br /> Dr . Petti explained that she had two lots which she wants t <br /> sell and asked for direction from the Board. She said at <br /> one time the lots were deemed buildable and how she is told <br /> they are not . She owns three lots held in single ownership <br /> for 24 years . Mr . Friel explained that the 1990 zoning <br /> change eliminated the protection as single lots . <br /> Ir . Makunas explained that she could, go to Town Meeting for <br /> a► change in the zoning by-law and that she might want to go <br /> to the Town Planner and ask him to submit ars article . Dr . <br /> etti said owners should have been notified. Mr . Friel <br /> recommended Dr . Petti get legal advice . <br /> Reorganization - Mr * Friel moved to reorganize the Board and <br /> name E. Govoni as Chairman . Mr , Makunas amended the motion <br /> to name E, Govoni as Chairman and Mr . Friel as clerk until <br /> July 1 . 1994 . Mr . Friel. seconded. All agreed. <br /> Minutes - Mr . Makunas moved to accept the minutes of April <br /> 27f 1994 , Mr . Govoni seconded. Al.l agreed. <br /> Mr . Govoni moved to adjourn at 9 : 20 . Mr .
