All agreed. <br /> Rita Shaffer TR . - Requests a Special Permit ander Section <br /> 174-17 of the Zoning By-laws to allow a 12f x 21t addition <br /> to the pre-existing non-conforming dwelling and the . <br /> relocation of a guest house in an R-3 zoning district on <br /> property located at 101 Waterway (Map 105 , Block 253 ) <br /> Mashpee, MA. ( owner of Record: Rita Shaffer TR. AdnoJo. <br /> Trust ) . <br /> Rita Shaffer TR. - Requests a Variance under Section 174-31 <br /> of the Zoning By-laws to vary the setback requirements in an <br /> R-3 zoning district on property located at 101 Waterway (Map <br /> 105 , Block 253 ) Mashpee, MA. (owner of Record: Rita <br /> Shaffer TR . Adnojo Trust ) . <br /> Members sitting: o oni , J . Regan, indic <br /> Mr * Shaffer explained that the house was thought to be <br /> within the New Seabury Special Permit zoning and they had , <br /> discovered It was not . They also found that part of their <br /> deck was on adjoining land and wanted to correct the <br /> infringement . He said they planned to relocate a seasonal <br /> guest house and connect it with the house and proposed <br /> addition. The Board of Health has approved the septic <br /> system. <br /> Mr . Regan moved to grant the Variance to allow a 6 , 2 side <br /> line setback and eliminate the encroachment on the <br /> adjoining lot . Mr . Mindick seconded. All agreed. <br /> Mr, Regan moved to grant the Special Permit . Mr . Mindick , <br /> seconded . All agreed . <br /> i Barbara B . Nichols - Requests a Special Permit under Section <br /> 174-17 of the Zoning By-laws to allow a pre-existing <br /> non-conforming seasonal cottage to be rebuilt and upgraded <br /> in an R-5 zoning district on property located ' at 59 Jones <br /> Road (Map 21 , Block 1 ) Mashpee, MA. <br /> Members sitting * J . Friel , E. Govoni , J . Regan <br /> Mr . Mindick stepped down from the Board for this hearing and <br /> Mr . Friel joined the Board. <br />
