TOWN OF MASHPEE <br /> Hoard of Appeals <br /> August 1 , 1994 <br /> The I ashpee Board of Appeals held a. meeting on Wednesday, <br /> August 10 , 1994 at 7 : 30 P .M. at the Mashpee Town Hall. <br /> Board Members present : Edward M. Govoni , James E. Regan <br /> III, Cheryl A. Hawver, Robert G, <br /> Nelson and Arnold D . Mindick. <br /> Board Members absent: John. J. Friel , Kenneth E. Marst rz <br /> Also present : William F. Hauck <br /> Mr. Hauck asked Board to review Krizansky Decision and all <br /> agreed they had no jurisdiction on doors and windows . <br /> Mr. Govoni stepped down as Chairman and Cheryl A. Ha ver <br /> chaired the first hearing, <br /> Richardson H. Jonas Requests a variance from Section <br /> 174-31 of the ZoningBy-laws for permission to vary the <br /> minimum lot area and frontage requirements in an R-5 zoning <br /> district on properties located at 3 , 37 , 3 , 42r 52, 54 and <br /> 59 .zonas Drive (Map 37 , Blocks 203, 204, 205, 206, 207 and <br /> Map 46 , Blocks 73 and 5) Mashpe, MA. (Advisement from <br /> June 8 . 1994 ) . <br /> Members sitting: J . Regan, C, IHawver, A. Mind . k <br /> Mr . Mindick stated he did not think the petitioner met the <br /> conditions necessary for granting a Variance . <br /> * r. Regan moved to deny without prejudice based on the <br /> finding of facts: <br /> . 10 the subject property consists of seven lots located <br /> the end of Jonas Drive <br /> 2 . the Jonas Drive subdivision plan, consisting of eight <br /> lots, was submitted to .the Mashpee Planning Board as a <br /> preliminary plan when the minimum lot size requirement <br /> for the R-2 district was 22 , 500 sf e <br /> between the date of the submission of the preliminary <br /> plan and the mate of the approval of the definitive <br /> subdivision plan for Jonas Drive, the minimum lot area <br /> requirement was increased to 40 , 000 sf and subsequently <br /> to Sor000 s . <br />
