Board of Appeals Minutes August 10 , 1994 <br /> the subject lots were protected from the applicability <br /> of zoning changes for the period during which the plan <br /> was being processed and for eight years from the date of <br /> endorsement of approval on the pian. <br /> . the Jonas Drive subdivision plan was endorsed on <br /> November 6. 1385 and the subject lots were protected <br /> until. November 6 , 1993 . <br /> 6 , the subject lots have at all times been under the <br /> ownership of the petitioner, Richardson H Jonas . <br /> 7 , the petitioner presented no information demonstrating <br /> any unique topography, soil conditions or shape of the <br /> subject lots , especially affecting these lots but not <br /> generally the zoning district in which they are located. <br /> . the Board of - appeals determined that the petitioner <br /> failed to meet the conditions necessary for the granting <br /> of a Variance . <br /> Mr , Hindick seconded. All agreed. <br /> Mr , Govoni joined the meeting. <br /> Barbara Nichols - <br /> The Board received a written request for a minor <br /> modification of Special Permit 94-40 to allow the <br /> foundation be moved 5 1 . Both the Board of Health and the <br /> Building Dept. agreed. Mr, Regan mored to grant the <br /> modification, Ms . Hawver seconded, All agreed. <br /> Zoning Articles -- fir, Govoni suggested that a memo be seat <br /> to Tom rudala and Tony Ferragamo requesting copies of any <br /> proposed zoning articles . Ms, Hawver suggested a copy be <br /> sent to the Selectmen. <br /> Mr . Govoni moved to adjourn at- P.M. Ids. Hawver <br /> seconded. All agreed. <br /> Elinor Walsh <br />
