3 <br /> Board of Appeals Mte - August 24x - 1994 <br /> Mr. Bowes informed the Board that he had received a Special <br /> Permit and Variance in 1992 and did not r alize the <br /> expiration dates on both. He now warted to do the same work <br /> with a house addition and garage. He explained that when <br /> the house was buil.. t wasassumed t was in the cluster <br /> zoning area and i was inter found to be outside of it . <br /> Mr . Friel mored to grant the Variance . Ms . Hawver seconded. <br /> All agreed. Mr . Friel moved to grant the Special Permit . <br /> Ms . Hauver seconded . All agreed, <br /> GregoryJ . and Carol L. Yurek - Request a Special Permit <br /> under Section 174-17 and 174-63 of the Zoning By-lags to <br /> allow the replacement of an existing non-conforming dwelling <br /> with a new single-family dwelling on property located in an <br /> R#3 zoning district at 199 Daniel ' s Island Road (Map loo , <br /> Block ) Mas pee, MA. <br /> Members sitting: B, Govoni , J. Friel , J, Regan <br /> Engineer Michael Grotzke represented the applicant and <br /> informed te 'Board that the builder and the Building <br /> Inspector had determined that it wouldbe better to replace <br /> the home rather than try to remodel from within. The <br /> proposed structure would then meet the FEMA code <br /> requirements for a high velocity flood plain location. He <br /> explained that house would be on the same footprint and the <br /> owners were also proposing a garage and pool . <br /> There was discussion of the int coverage restrictions <br /> imposed by the large percentage of wetlands and the Board <br /> determined that the proposed coverage within the <br /> non-wetland area was acceptable . Total coverage would be <br /> 15 . 300 including the wetland area, Mr . Haug said the new <br /> coverage applies to new properties . Mr . Govoni said that <br />' this should be included in the Special. Permit . <br /> Tom Tones , an abutter , asked if house could be placed where <br /> the pool was located. Mr. Grotzke explained that the septic <br /> system had to be located far from the wetlands and that <br /> Conservation had approved all the locations . Mr . Jones said <br /> he was concerned about obstruction of his view but found the <br /> property attractive . <br /> Mr , Friel moved to grant the Special. Permit and allow the <br /> proposed lot coverage of Mr . Regan seconded. All <br /> agreed. <br /> Christopher Foss -- Requests a Special Permit under Section <br /> 174-17 of the Zoning By-laws to allow the relocation of a <br /> non-conforming garage in an R-3 zoning district on property <br /> located at 417 Mono oscoy Road (Map 124, Block ) Mashpeer <br /> A, owner of record: Lisa Drake TRS . ) <br />
