Andy' s Market & Route 151 Shell - Both businesses wish to make improv m nt , to existing conditions . Mr. vir ililo stated that�te permit could not be issued for a number of - reasons - the number one issue being -public safety* The other issue is the town ' s liability should an accident occur on the premises due to their signs, etc. are on town property,, Mr. Anderson on Andy' s Market stated that he has a pre -existing non-conforming use and that if he were building the building today, it would have to be set back 100 feet from the highway, however it is now 49 feet from the highway. -therefore, current engineering is not in lime in this particulars instance. Mr. Anderson feels that Mr, Virgilio has not core up with an alternative other than leaving the property as it is . All agreed that both of these sites should be cleaned up and improved cosmetically. The owners were requested to have their attorneys prepare an agreement stating that they understand that the town of Mashpee would be held harmless for anything that occurs on that property due to Shell' s encroachments , Also requested was an agreement that all parties agree that written notice within a specified number of days i,e. o that encroachments be removed if the town needs to make improvements to road, These agreements will be prepared by the owners attorneys and forwarded to Town Counsel for review. OLD BUSINESS 1 . Mr. Gottlieb moved to accept Mr. Howard Horton ' s proposal to provide legal and consulting services to the town in connection with Cable Television licensing, contingent upon the appr' ova'l as to form o Town Counsel. Mr. Hanson seconded the motion. All were in favor. Mr. Carter was not present for the vote. OTHER OLD BUSINESS 1 . Mr. Carter stated that Mr. Reardon had located an abandoned vessel by-law regarding the dredging equipment . 2 Mr. Canter stated that the causeway safety barriers leading to 0 Monomo scoy Island have been knocked down and the residents were concerned. . Mr. Car-ter stated than there is concern because the Senior Citizen Center is not being cleaned on a regular business . It has been two weeks since the custodian has worked. Mr. Carter was informed that the Personnel Board is looking for a replacement .
