Andy' s Market & Route 151 Shell - Both businesses wish to make <br /> improv m nt , to existing conditions . Mr. vir ililo stated that�te <br /> permit could not be issued for a number of - reasons - the number <br /> one issue being -public safety* The other issue is the town ' s <br /> liability should an accident occur on the premises due to their <br /> signs, etc. are on town property,, <br /> Mr. Anderson on Andy' s Market stated that he has a pre -existing <br /> non-conforming use and that if he were building the building today, <br /> it would have to be set back 100 feet from the highway, however it <br /> is now 49 feet from the highway. -therefore, current engineering <br /> is not in lime in this particulars instance. Mr. Anderson feels that <br /> Mr, Virgilio has not core up with an alternative other than leaving <br /> the property as it is . <br /> All agreed that both of these sites should be cleaned up and improved <br /> cosmetically. <br /> The owners were requested to have their attorneys prepare an agreement <br /> stating that they understand that the town of Mashpee would be held <br /> harmless for anything that occurs on that property due to Shell' s <br /> encroachments , <br /> Also requested was an agreement that all parties agree that written <br /> notice within a specified number of days i,e. o that encroachments <br /> be removed if the town needs to make improvements to road, <br /> These agreements will be prepared by the owners attorneys and <br /> forwarded to Town Counsel for review. <br /> OLD BUSINESS <br /> 1 . Mr. Gottlieb moved to accept Mr. Howard Horton ' s proposal to provide <br /> legal and consulting services to the town in connection with Cable <br /> Television licensing, contingent upon the appr' ova'l as to form o <br /> Town Counsel. Mr. Hanson seconded the motion. All were in favor. <br /> Mr. Carter was not present for the vote. <br /> OTHER OLD BUSINESS <br /> 1 . Mr. Carter stated that Mr. Reardon had located an abandoned vessel <br /> by-law regarding the dredging equipment . <br /> 2 Mr. Canter stated that the causeway safety barriers leading to <br /> 0 Monomo scoy Island have been knocked down and the residents were concerned. <br /> . Mr. Car-ter stated than there is concern because the Senior Citizen <br /> Center is not being cleaned on a regular business . It has been two <br /> weeks since the custodian has worked. Mr. Carter was informed that <br /> the Personnel Board is looking for a replacement . <br />
