MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 27, 2018 <br /> Mike Mendoza, Building Commissioner wanted to know if the permit with the <br /> Conservation Department expired. <br /> Attorney Wall said that the Conservation permit will not expire for another year and is still <br /> valid. The pier is longer than.70 ft. <br /> Mr. Goldstein read the Conservation Department comments into the record. There was no <br /> comments from the Board of Health. <br /> Mr. Furbush addressed the issue that the Special Permit mentioned that a house should <br /> have been built and issued an occupancy permit before starting construction on a dock. He <br /> said he has no issues with extending the permit. <br /> Mr. Mendoza had concerns with the plot plan dating back in 2012 which stated that there <br /> are no none marked navigational channels or moorings within 100 ft. of the proposed flow. <br /> This site plan is 6 years old, so the area may have changed since then. A new plan should <br /> be drawn up to reflect any changes to the area.It's not in Mr.Mendoza's prevue,but wanted <br /> to let the Attorney know that it will have to be readdressed. The FEMA has changed the <br /> flood maps for the Town of Mashpee as well. <br /> Mr. Blaisdell commented that there have been many cases that a ruling can be conditioned <br /> upon Conservation approval but in this particular case, Mr. Blaisdell wants Conservation <br /> to revisit this project. He would rather postpone the case until hearing from Conservation. <br /> Attorney Wall said that the application falls within the qualifying period of the Permit <br /> Extension Act. The Order of Conditions is valid for 3 years from date of issuance in 2012 <br /> and adding four years with the extension act would make the permit valid until 2019. <br /> The Building Commissioner suggested that Attorney Wall reach out to the Conservation <br /> Agent and confirm that his permit is still valid for another year. He offered to talk with <br /> Drew to make him aware of the situation as well. <br /> The Board agreed that an email would be needed by the Conservation Agent. Mr. Furbush <br /> would also like to know if there's a potential issue with the comments that Mike mentioned <br /> regarding the FEMA situation and navigational flow. <br /> Sharon read the Inspection Department comments into the record. Mr. Furbush read the <br /> Conservation comments into the record. <br /> Sharon read an abutter letter into the record that is not in favor of the project. <br /> The Attorney asked for a continuance until Wednesday, July 11, 2018. <br /> Mr. Blaisdell made a motion to accept the request for continuance until July 11, 2018. Mr. <br /> Goldstein seconded, yes. All were in favor. <br /> 3 <br />
