MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JUNE 27,2018 <br /> 534 Cotuit Road: Petitioner, Augustine Lett, requests a Written Finding under §174-17 <br /> of the Zoning Bylaws to allow for reconstruction and extension of an existing deck on <br /> property located in an R-5 Zoning District, Map 16 Parcel 30, Mashpee, MA. (Owners of <br /> record: Sherri and Robert Stivaletta). <br /> Mr. Augustine Lett, 38 Crestview Drive, Falmouth, MA represented the applicant's <br /> petition requesting to build an extension of a deck from 4 ft. to 7ft. to allow more space <br /> from the front door. The extension is getting too close to the property line. <br /> The Board wanted to confirm the current setbacks of the current and proposed deck. They <br /> confirmed that frons.Cotuit Road,the setback is 33.4 ft.,the side setback is 42.5 ft.,and the <br /> back is 45.7 ft. The existing lot coverage is 12%. This is a pre-existing non-conforming <br /> situation where he is extending a non-conformity. The front yard setback is being increased <br /> to an additional 3 ft., which is the reason for the Written Finding. <br /> Mr. Lett said the deck is 4 ft. wide in the front and will be extended another 3 ft. getting <br /> closer to the lot line. The stairs are being squared off and do not count as lot coverage. <br /> The Board had a discussion regarding existing and proposed lot coverages depicted on the <br /> plan going forward. The application can be revised as well. <br /> There were no other comments from the Board or audience. <br /> Sharon read the Conservation, Board of Health, and Inspections Department comments <br /> into the record. <br /> Mr. Bonvie made a motion to issue to Augustine Lett of 534 Cotuit Road a Written Finding <br /> under the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2.
