Greelish questioned Attorney Connelly as to whether <br /> he is�reguesting 'a postponement. <br /> !F <br /> F <br /> _ - Attorney Connelly responded, no. <br /> Attorney Reardon stated a notice was sent to Five Star <br /> Enterprises that a public hearing would be held to discuss <br /> the possible revocation or suspension of license #9918 for <br /> the failure. to comply with Mashpee Board- of Health refuse <br /> regulation which became effective April 2 , 1991, "Five Star <br /> Enterprises is in violation of section 1 of the regulation <br /> for failure to comply with the Upper Cape Regional Transfer <br /> Station rules and regulations in that payment of tipping fees <br /> at the Upper Cape Regional Transfer Station to the Town of <br /> Mashpee are not being made in a timely fashion. " Invoices <br /> state that payment must' be made within days of receipt of <br /> the invoice. # #Five Star has an outstanding balance of <br /> $5091 .37 dating back to invoice #167 of January 16, 1991. 11 <br /> "Failure to comply with section 2 of the same regulationre- <br /> quiring that all licensed haulers transport their refuse to <br /> Upper Cape Regional Transfer Station which is currently the <br /> only Board of Health approved commercial disposal site. " At- <br /> torney Reardon stated he has been notified that the issue of <br /> the outstanding balance has been resoled as payment was made <br /> today. <br /> Attorney Connelly stated the issue of arrears is irrel- <br /> evant. ' The secondary issue is an issue that is becoming an <br /> issue throughout the Cape unless the solution is a regional <br /> solution promulgated by the Assembly of Delegates to the Cape <br /> Cod Commission. " "Towns passing regulations in midstream <br /> change how haulers must conduct their business after they <br /> have already contracted. " <br />
