t
r
MINUTES May 9, 1991 4 BOARD of HEALTH
40 towns, 15 of which are located on the Cape, that are creating
their own legislation. ' How can an industry comply with 4
or 50 regulations. "
Mr. Greelish stated the cape Cod commission and the As-
sembly of Delegates are working on a comprehensive regulation
for all cape towns..,
Attorney Reardon recommended individuals in attendance
review the regulation and submit suggested modifications or
i amendments for the Board's consideration that they think are
applicable.
Mr.. sodenb ;rg stated what the Board is not focusing on
is the illegal applicator in the field.' "It is the local
landscaper that is soliciting work and applying pesticides
without any licensing, training or insurance. 11 "Pesticides
are sprayed from the end of .a hose by these people or
homeowners rs with no- backflow preventors. " "It is my conten-
tion that these individuals are the biggest potential cause
of groundwater pollution on cape Cod, " "These landscapers
can travel in pickup trucks, apply these materials at two to
three times the label rate. "Mr. Bode burg questioned
whether the Mashpee Board of Health will apply pressure to
the Massachusetts Pesticide Board to get these , illegal ap-
plicators off Cape cod. " " e8ticides are stoned along with
food items in the local supermarket which, in my opinion,
poses a large threat to the public health..11
Mr, Greelish stated those issues have not gone
unaddressed. "through our interactions with the initial
regulation it was learned what enforcement was capable by the
Pesticide Board, which was not impressive at the time, " Mr.
Greelish stated it is not this Board's intent ,to put applica-
tors out of business. 'Any assistance that could be provided
will be considered by this Board and we will ensure the
County commission receives those comments. 11
Mr. Doherty commented this Board is faced with the prob-
lem as to how to control the small indpndent operator.
Mr, McQuaid uaid relayed one of the reasons for incorporating
a truck inspection into the regulation was that 'in contacting.
D.E.P. , Div. of Groundwater Pollution control, it was
learned that anti-backflow or anti-siphoning -devices are not
inspected on the trucks.
Mr. McMahon stated his company does not use siphoning
devices.
r ■
i
■
r !} I
Y
4
