Officer Ames : We held the dog for 17 days at Temrock Kennels <br /> under a quarantine. On two occasions when I <br /> saw the dog there -- I've had no physical contact <br /> with the- dog -- Mrs. Johnson took the dog over and <br /> Mrs . Johnson removed the dog from. Temrock, however, <br /> once I try to feed the dog and it attempted to bite <br /> me. It is not a friendly dog other than to the <br /> Johnson family and it does appear to be to friendly <br /> to this young man. <br /> Town Counsel: Do you have \any specific recommendations you would <br /> like to make to the Board in your capacity as Dog <br /> Officer of the Town? <br /> Officer Ames: Well, if the dog is a protential bitter or if it <br /> annoys anyone in this Village, that we have it <br /> removed from this Town. It is a recommendation <br /> that I have made in the past and that's the <br /> recommendation I will make now. <br /> Town Counsel: Let' s get the .record straight on this . You don' t <br /> know of anyone that the dog is annoying in this <br /> Village. <br /> Officer Ames: Yes I do. He is present here now-but has choosen <br /> not to testify-. <br /> • Town Counsel: Yes Mrs. Binienda do you have something you want <br /> to say about the dog annoying anyone by barking <br /> or . . . . <br /> . Mrs. Binienda: The dog- barks and chasesmy -husband- if he is out <br /> walking. He -has to walk--because of =a back problem. <br /> Town Counsel: Does the dog--annoy- you when -it is tied up? When <br /> it is tied tip- it doesn' t chase. you •Mr:=- Binienda? <br /> Mr. Binienda: . No it doesn't. <br /> Town Counsel: I think it would be appropriate .at this- -time, for <br /> the owner of the dog to address= th'e.Board, _ There <br /> is no statutory requirement.that -she give testimony- <br /> under oath. There is a statutory requirement that <br /> the complainants give testimony- under oath. . I've. <br /> going to stick strictly to the letter of the <br /> statue that does not require that Mrs. . Johnson give <br /> testimony under oath because there isn't any <br /> requirement that she be placed under oath. <br /> Mrs. Johnson: I will give it under oath. <br /> • Town Counsel: That' s alright. You may say anything that you <br /> would like 'to at this time to the Board- with <br /> reference to .the dog. <br /> Mrs. Johnson: The dog was given to us to protect our home. He <br /> is friendly with people inside the home. The dog <br /> was teased by a 4- year old. He did bit Dougie <br />
