It is going to fall down. We will be <br /> lucky if that wall goes through this winter. Retaining walls are <br /> not the answer, It was suggested by Phil Holmes , the engineer that <br /> the Town hired to assist rye in this particular case , that rriprap <br /> is the answer.' I contacted the - Division of Marine Fisheries and <br /> spore with Buzzy DeCarlo and he indicated that they have no funds <br /> available to assist in .-the project but that they will . furnish the <br /> manpower. I asked Darold Collins if he .knew of anyone in the. <br /> Town that had a crane .. A crane is very necessary to install hose <br /> large rocks.. ' Harold said- that he knew of several contractors in <br /> Falmouth that had cranes and he was suire that he could prevail <br /> upon them to give the Town a break price wise . He suggested to <br /> rte that the price he could probably get for the Town is $leo. 00 <br /> a day. we can utilize our Town trucks ,, etc, to bring the rocks <br /> down. Perhaps we could core to a solution of the problem that <br /> exist there and at the sane time cure the problem that e is t between <br /> the Town and Mrs. Mills . She has a legitimate mate complaint. I don' t <br /> thinly it is a legal complaint but it is a legitimate complaint. <br /> We have the. right ' in my judgement to use the land that we dial use- <br /> by virtue of an easement that we acquired in 1962. She has a <br /> complaint based upon the fact that she says we did ,not have the <br /> right to go upon her lana and put the wall up. I thinly she' s <br /> wrong there but the second part of her complaint is that the actions <br /> of the Town deprived her of her ability to� use the little beach that <br /> is there that she used for swimming purposes . The wall did prevent <br /> her from- using the beach, there' s no doubt about that. I submit <br /> that we have . the right to that lana. The bottom lime is that we <br /> have to replace the wall that is there before it falls clown and we <br /> are faced with the sane problem that we' ve been faced with for <br /> years . I think we can do so- through installation of -riprap which <br /> has been recommended by the engineer.. I think it is worthy of <br /> exploration by the Board to go forward as to the possibility of <br /> doing this. <br /> Chairman stated that we are going to have to contact the Conservation <br /> Committee for an emergency permit. <br /> Town Counsel responded that they are aware of the problem and that <br /> they have been up there. <br /> Chairman stated that we are going to have to find out where we can <br /> get the bolders . <br /> Town Counsel informed Chairman that Harold Collins thought that <br /> they can be purchased from Lawrence Lynch. He also thought that <br /> he could prevail upon them to donate therm to the Town, If we can <br /> can assure her attorney that we can do something say within the <br /> next six months to a year, I thinly Mrs . Mills will drop the case. <br /> I think -we are going to win it anyhow. <br /> Chairman asked that we find out how much it - is going. to cost to - <br /> repair it with riprap. He asked Town ` ounsel to communicate to <br /> Mrs. Mills attorney indicating that we are going to proceed basically <br /> in - accordance with Town Counsel' s suggestion. He also stated that <br /> perhaps the Executive secretary can touch }case with the Building <br /> Inspector in regards to material, etc. <br /> l - <br />
