I have a feeling- <br /> that, he hasn' t- been in touch with Mr. Costa on this suggested <br /> settlement. I' .have therefore suggested to the Baan that the <br /> Board communicate directly with Mr. Costa. Remind him of his <br /> pledge to this Board that whatever monies he recovered would be <br /> turned over up to the amount we had paid him. more or less to <br /> make him' aware of the fact of the obligation he pledged to the <br /> Board* There is no legal obligation for hire to do so except by <br /> va..r u l of the lien we have against him. what I arra suggesting <br /> that - in the contents of a settlement he has no legal obligation <br /> to settlement. <br /> Chairman stated that he would life the records to show that Mr. <br /> Costa assured this Town through Frank Hicks, Kevin- 0' Connelly- r'd <br /> h-ims l f that he would infact reimburse the Town. Selectmen Garland <br /> and Thomas were also aware of this. Chairman requested that <br /> we communicate with Ir. Costa directly and that he would also like <br /> to involve Kevin O' Connell. <br /> i <br /> Town Coun el stated that he would further like to indicate that <br /> at this time, Mr-. Costa is also receiving a disability pension <br /> from the County. It is a situation by him not receiving any part <br /> of the court settlement funds , I don' t consider- this being a <br /> financial burden on hi . He does receive disability income and <br /> the Town is entitled to the return of those 111F funds . <br /> i <br /> 16 . Town Counsel informed Board that in regards to Patrolman' s <br /> i chis n' s .applicati n for disability retirement, his application <br /> is pending before the County Retirement Board. A doctor has <br /> been appointed by the County Retirement Board; Patrolman Aitchison <br /> has appointed his doctor and we are waiting now for the Commis.6ioner <br /> of Insurance to designate a thi d doctor who will act as Chairman <br /> of the Panel.. This has not been done. The Executive Secretary to <br /> the Retirement Board- called the Insurance Company for me and he <br /> was informed- that. the appointment should be corning through between <br /> Ch ri s tm . New and ear , with that in mind, I would submit that it <br /> will probably be another two or three months before the Medical <br /> Panel makes it decision. Realistically, we are probably loafing <br /> towards the 1st of April before Mr. Aitchison comes off the payroll <br /> of the Town, <br /> 17, Selectman Thomas stated that in connection with a letter received <br /> from firs. Eleanor Harding regarding problem she is having with old <br /> Hollow Road being opened up to continue onto Bach Road, she would <br /> like Town Counsel and the Executive secretary to look into what <br /> avenue we can tale, if any, to assist her. Board concurred. . <br /> Chairman stated that the Acting Superintendent of Streets could <br /> probably help. <br /> Town Counsel informed Board that the Janice Mills ' case was tri led <br /> on Monday and Tuesday of this week . After the case concluded, I <br /> had the opportunity to spear with Mrs. Mills ' attorney and he and <br /> I explored the possibility of settling it at this late date. one <br /> _l2_ <br /> l <br />
