O'Connell said he doesn' t feel` we should stop everything, <br /> -'but should be cautious about ,what is undertaken at this time. <br /> Mr. Murphy said he feels it is urgent to. get the $100 that is <br /> being requested for engineering services to get a determination of ' <br /> the street line of Old Barnstable-Falmouth,`Road, as there is a <br /> possible encroachment that could involve the Town in litigation. <br /> Sel . 'Thomas urged that wednut'tojethe"r what is .obligated, so the <br /> Selectmen will know where#they are.--,Then, if necessary, a Special <br /> Town Meeting could be' called to-request more funds for the Legal <br /> and Engineering Account. <br /> - Town Counsel pointed out'.that the ?Selectine'n know there is one major <br /> piece of litigation *pending that will require a constitutional con- <br /> sultant. This could possibly exhaust all the remaining- funds . <br /> Ser. O'Connell -moved no 'actionton, the .requests for $1 , 500 .and $750 , <br /> but that the $100' regiest be ',approved. ' The vote was unanimous. ' <br /> 2) Regarding .the request from The Wigwam to close for 30 days , <br /> Sel - Thomas moved approval .The. <br /> O 'Connell abstained from vot <br /> ing, and Chm: Garland voted in favor. Permission granted. <br /> 3) Regarding the Letter of Assignment received from the 'Mashpee <br /> Construction Company, Chm. Garland explained that the station <br /> which has a contract to supply the Town vehicles with gasoline <br /> • has been sold by Mr. Umina to Gerald A. Monaco. This letter <br /> states that Mr. Monaco has agreed to take over the contract. <br /> Town Counsel-'asked if the Town has a performance bond on - this' <br /> contract? ,-Answer: "No" . Then Mr. Reardon would like to have ' <br /> Mr. Monaco come in and sign the .Agreement. Set. Thomas asked <br /> him to make certain a ,date of transfer is stipulated. Town <br /> Counsel said the Town should obtain an endorsement. Sel. O 'Con- <br /> nell . moved, and Sel. Thomas seconded the motion, that the Letter <br /> of Agreement be accepted according to the terms requested by <br /> Town Counsel. A unanimous vote. <br /> Town Counsel asked the Board to vote to accept the Assignment <br /> only if the attached statements were added as part of the Agree- <br /> ment, as this had gone out forpublic bid, there should be, some <br /> assurance of continuity. Sel : ,O'Connell made his motion as a- <br /> mended by Town Counsel. (see attached) <br /> 4) Chm. Garland summarized a letter from the State DPW informing the <br /> Town of Mashpee that their State Allotment amounts to: $51, 203 . 00 , <br /> with the. Town' s 25% share amounting to $17 ; 068 . 00 . . The funds will <br /> now have to go to Town Meeting for appropriation. It was a unani- <br /> mous vote to accept the notification of appropriation from the State. <br /> 5) Chm. Garland read the request to appoint Jane Bartholomew as a <br /> Special Municipal Employee so that she could serve as Clerk to the <br /> Board of Registrars. Sel . O' Connell moved approval, seconded 'by <br /> Sel. Thomas. A unanimous vote. <br /> EXECUTIVE SECRETARY REPORTS . <br /> There will be a Public Hearing tomorrow evening at the Sr. Citizen <br /> J <br />
