Minutes of BOS Meeting " <br /> 1/6/82 <br /> Page 6 . <br /> •TOWN COUNSEL JOSEPH REARDON <br /> Wilbur Oakley <br /> Town Counsel reported that he had a bit of good news for the Board. <br /> In the contempt complaint that had been brought against Wilbur Oak- <br /> ley sometime ago, for the illegal-.operation of a stump dump, and in <br /> which Mr. Oakley had been ordered to pay the Town of Mashpee $500 , <br /> (a portion of the cost the Town had to expend to enforce the regula- <br /> tion) , a sum of that fine had been handed to Mr. Reardon on this date <br /> to be delivered to the Town. Mr. Oakley was supposed to have gotten . <br /> permission from the Town for ,the dump, or fill over the debris on hisproperty. When he hadn' t done so, Town Counsel brought a motion for <br /> contempt, and Mr. Oakley was ordered to pay $500 . He " just turned over <br /> $400 , and promised to pay the balance of the fine ($100) on .Friday. <br /> He also promised to comply by filling tomorrow. The contemptmotion <br /> was continued until January 20 : The judge had threatened Mr.- Oakley <br /> with incarceration, if necessary. <br /> Bobby Byrnes Pub° <br /> Town Counsel reported that Bobby Byrnes had gone . to .court this date, <br /> seeking a temporary restraining order to enjoin this Board from en- <br /> forcing* l o 'clock closing hour . The judge had determined that there <br /> was not sufficient emergency to grant relief, so had denied "the. motion. <br /> The judge felt Mr. Byrnes had not demonstrated that there would be ir- <br /> reparable harm done by the imposition of the new closing hour, so he . <br /> refused to issue a rstraining order•. <br /> Clayton Peters vs . the Town of Mashpee <br /> Town Counsel reported that a case has been entered, claiming the fa,s <br /> tening device in the ambulance that was transporting Mr, Peters was <br /> faulty, by his estate. Mr. Reardon- pointed out that this is really a <br /> third party action, involving- our insurance carrier. <br /> Kevin O 'Connell re: Bobby Byrnes Suit <br /> Sel. O 'Connell asked Town Counsel to see that his name is removed from <br /> the list-of defendantsiin the suit Mr. Byrnes has brought against the, <br /> Town for the l o 'clock closing. Mr. O 'Connell pointed out that he was <br /> absent from the Board on the day the vote was taken in that matter. <br /> Chm. Garlanda. thanked Town -Counsel for 'his .report. <br /> t . <br /> NEW BUSINESS <br /> 1) Chm. Garland' suinmarized the -letter from Mr. Jacobson requesting <br /> engineering assistance from Mr. Rowley. He pointed out, relative <br /> to the request for $1, 500' for alocation plan of the area encom- <br /> passing the fire station, police station, etc (see attached) , that <br /> there is presently no comprehensive plan of -that area. Sel'. O 'Con- <br /> nell asked if this can' t be put off until a time hwen the Town does <br /> not have so many other matters pending that will require funds from <br /> our Legal and Engineering Account. He questioned if the Town can <br /> afford to spend this money at this time? _Sel . Thomas pointed out <br /> that we have a Building Committee working on plans for a new DPW <br /> Building. They can 't proceed until they know the site , she said. <br /> "Should be stop everyting?" she asked. <br />
