*, Page 6 .
NEW BUSINESS:
1. sel. Garland, "they now own the property as a smatter of records in land
court in the state of Massachusetts, '@
Mrs.. Simpson, - "it is a question of repairing the road, I art talking about. "
1. Garland,, "just a minute,*'
we are talking about two different things .
I thihk you are being an alarmist by making any such- statements in the
world that the state of- Massachusetts is going to withdraw the amount of
money that has been appropriated for that beach, because they have al-
ready -acquired
l-
rea ly -acquired it, whether or- not - they have gone through the formal
legal procedure of a protanto payment to the current existing- landowners,
I don' t know. I do know of two cases where the protanto payment has been
extended. ' whether ,it has been completed entirely I do not know. That
is a procedure which comes after the forma-1 land taking. They- own it
period. As far as the road is concern it has been my 'concern for a. long
time, because I have known that the, existing road does not lie on the
official layout which was performed by a Beard of Selectmen sitting back
in 1960 something or other. This week we have- found the original by-
law and the record for filing in land court.. We knew that. a taking had
been voted by a prior Town Meeting, because a taking is zroted by- a Town
meeting does not make that or constitute that- as a legal taking, it
must be filed in land court. That was done. we now know the dates when
this transpired. The problem is regardless ofwhat you feel or who is
responsible for that road meandering to where ever it meanders. There.
is an official legal layout of that road and that must be the way the
road is constructed. I 'have a recollec-tion from somebody, and I am sorry
I can ' t remember who made- the statement; but somebody rade the statement
that $800, 000 , eras a sufficient amount- of money to reconstruct the road
on the official town layout. I will agree, I s ai,d this last Monday night
at the meeting, I don't give a dam.-for these people coking from off cape
to this gnat and glorious south Cape Beach to watch the terns nesting
or to watch the marsh grass waving- in the wind, or whatever -you want to
call it, I am..here and I sit here, I have been elected. by the people of
this Town and I will stand here and- defend their- rights before I defend
the rights of anybody else in this State. „
Mrs. Simpson replied, " May I ask if you are going to defend the rights
of thep eo le of New. se abury that .come down here 'and shoot their- golf
balls around, and go down to the beach and other things , does it make
a difference who you defend Mr. Garland?"
el.. Garland,' "It 'absolutely does ! "
Mrs . Simpson, "Glad to know that, "
se l. Garland, "I t absolutely does , and I say'. to you that you are being
pertuitive in, your remarks and I believe that these are the sane kind
of remarks .that you have Trude for months ,, on end. You have total tunnel
vision. Absolutely total tunnel vision, if- anybody doesn' t agree with
any concepts that you have they are no good. I am sorry that you feel
that way because I think you are a very narrow minded person. "
Mrs. Simpson- , swell thank you Mr. Garland, corning from you, I will take
it with a grain -of salt. Now may I say and this will be my- last remark:
if you knew that this road was a problem- some time ago and you were a
Selectman why didn' t you bring it to the attention of the Community*
i
i
