Y
Selectmen's 1ofe int
iF 2/22/8 {
Page 2.
Mr. i irs er -asked if the approval and surrey would take more than a. month? Mr, Virgilio
responded that it could take less than a month. Atty e Reardon asked if a east estimate
had been obtained? Mr. i.rgilio confirmed that he had gotten an estimate' f between
$7,000 and .° 7,500 - but that would apply only if the bounds could be located., If' the
boundary markers 'hare not been set it will cost more. - So he was coy sioering asking
approval -for the expenditure of$10,000. Atty,, .Reardon said it will be very important
for permanent bounds to be set when this work is done. All agreed
Hera . ealander was recognized. lie said he resides near Great Oak Road. Elis land has
been surveyed, and is well marked, He said his' land extends 6 or ' ,feet. ov er the road.
He said he understands that the read was laid out over an "ancient way".. Sel. `horras
'said no one is sure what was considered ars ancient way there. 'Mr. Seahtnder said his
plot plan shows it as ars ancient way, awnd his plan has been registered, lie asked, when
the road has been surveyed, will it be re-aligned? Chmo Thomas said what is planned
right now is that the road will be staked out according to the legal layout. Mr, Sea-
lander claimed that it could go right through his backyeard.
Chm. 'phorias _turned to Town Counsel. She doesn't know quite how to respond to l r. Sea-
iander,'s problem. Apparently the present road goes through his card. No one knows where
the legal layout will take the road. She feels a response will have to wait for the sur-
vey to be completed. Town Counsel confirmed thiS4,
Rep. Cahir.said the Selectmen will authorize the survey to shote the proper layout. The
Selectmen then will determine if that hurts anV abuters, The state can only spend funds
on the legal layout. The Sel.ectnien may decide to take land on the other side* Atty.
Reardon said he understands the -layout was adopted at a Town Meeting some time ago? Chm,
Thomas presented him with a. copy of the Town Meeting Article a op d in 1963, and amended
in 1964 see. attached .
Morris Kirsner said he feels the situation has been well. explained. If the survey shows
there are any violations by the town, the town will- take care ofthea. If it shows there
have been violations by abutters, they should have thein attorneys contact Town Counsel.
to work- out a solution* He urged abuters to feel. .comforted by that.
Robert DeLory was recognized. He said the road is shown on an 1877 map, bounded by cement
bounds, a,nd,recorded. It has b : n used as such for years. A developer came in and cut
down sore trees in the area, some- years ago o
Chm. Thomas stated it was obvious the next step is to have the surrey done, and she called
for a motion to approve an amount not to exceed $10,000 to perform the survey and lay out
the road. S l. Hanson declined to axe the emotion, He said he wanted the state, to know
that he is in total- support of them, but he has some questions that he wants answered
first. He acknowledged that. it had been agreed that only the road would be discussed at
this meeting; so he will hold. his questions until they can be answered at a future meeting
f the Advisory Board. He said he will r`take' a motion :that the vote be postponed unless
other matters can- be discussed at this time, He said they were questions khat had been
massed at the last meeting of the Advisory Board. Chm. Thomas said it would be helpful
to the Advisory Board, and Chm. Kirsner of the Advisory Board concurred, .if Mr, I--;anson's
questions could be put in writing. Sed.. Manson agreed to do so,
John bower of the d ry [;orr I -ee, said the most fundamental step is to determine the
road. Nothing else should delay that. He does not feel it is .justified to lose a week
or. t%ao far any- other considerations. But Sel. Manson said he would not vote to move
ahem until his other questions are ans:ered. Mr. iolinskr of the Advisory Committee
as ed i the ue t ,on could be raised
after the meeting,,. with the people from the state
who were present's This seemed agreeable to all present.
Chm. Thorras asked if there were other questions relating To Great Oak load There being
none, the meeting was adjourned at -7:
