He <br /> explained what the word "family" meant in law terms . He also stated <br /> that no discrimatory action. can be allowed 'in a con enant. <br /> -Chrr . Garland stated that Representative Cahir has strong feelings <br /> about this -as his feelings are that people are using this as a <br /> tax shelter. He also stated that it appears as the tern can do <br /> nothing at this time, the town cannot obstruct Mr-. Saunders , but <br /> that the Building Inspector can. do his duty and enforce -the by- <br /> law. In this case prior to o cupancy the Building Inspector would <br /> have to inspect the premises . Mr. Rick Buchsteiner asked if he could speak- for -his wife <br /> Maureen O'Connell... - He came to discuss the drainage problem in <br /> Mr. Hlakeman' s. development. He showed pictures of the Briarwood <br /> area, He said .that last January the complaint was about that <br /> area and after all the neighbors care to the selectmen Mr. Blakeman <br /> one day later dug a dutch but did not- cover it, he only made it <br /> safe two, months later. Chin. Garland explained that this happened <br /> when the Acting Building-. Inspector was here. Discussion followed <br /> on Mr. Blakeman digging and pouring a foiihdation without a: permit,- <br /> Chm.. Garland eXplained that Mr. Collins was there on some other <br /> Town business and when he saw what was happening and Mr. . Blakeman <br /> was there he had to make a judgement the Town would of been sued <br /> so he allowed Mr. 'Blakeman to pour, but he was told not to do <br /> anything else. sel. Terror explained that Mr. Collins , the Building <br /> Inspector feels strongly that things be done right. <br /> Mr. Richard Dubin, Attorney-, representative for. Mr. Blakeman and <br /> Deeridge Trust spoke.. He explained that Mr. Blakeman has had <br /> financial problems and. that he is trying to make things right. <br /> He also stated that the permits were being held by the Building <br /> Inspector. <br /> Vernice Polka, resident, said that she has lived in that development <br /> for seven years and- that nothing ever~ gets done as far as the <br /> drainage problem. <br /> hm. Garland stated that this sounds like a Civil type thing. This <br /> is a problem between the homeowners and developer. <br /> Town. Counsel explained how the developer gets to pit the roads <br /> in and how the covenant with the Town is re le a d. He also gave <br /> these people the same advice as in January pertaining- to the fact <br /> that they should get an Attorney' and if they feel that they have <br /> been wronged to pursue ' the matter in a civil action in court. <br /> sel. Terry explained in -summary what he felt the problem was and <br /> what he recommends concurs with Town Counsel . <br /> Ernest virgilio stated that he had already tried to help Mr. Blake- <br /> man in January and that he wanted it on record that he wants nothing <br /> to do with this . <br />
