CJS SNE CANT . n the memo from the Executive Secretary relative to the request from Mr. Robert c aro, Department.--of Environmental Development, for the - use f the Town parking lot and beach at S oath, Cape Beach Chm. arl and explained that on August 12, .19 .there will be a ceremony h ld there because of the acquisition of the -beach and Washburn Island. Motion by Sed.. Terry to allow - the request 'with the proviso that the helicopter that will be bringing-,Governor Dukakis does not land on the -Town beach or parking lot. Seconded by Chin. Garland. This is a vote. Board returned to appointments and hearings . APPOINTMENTS AND- HEARINGS :1.5 p.m. - Mrs, Everett came as the representative to Timberline Shores Association and was the speaker-, She explained that the reason they carne was to discuss and make the Selectmen aware of -the leasing of land to mentally retarded people in their~ neighborhood. She wanted. it -on record -that- they are opposed to the transfer of property on Cotuit . Road, presently owned by. Franca Saunders. o f She rbon, Ma. They understand that this property is' to be leased -to the- Human Service resource , Center., Inc, She stated that papers have not been passed yet, but that Mr.- Robert' Alexander is going to burr the property. This is ars investment group and he is the principle or trustee. Board asked Mrs . Everett what sh wanted. the Board to do. Chris.' Garland Stated that after the building is bought and if they do s.orething against our zoning- lags or building lags than the Board can probably help,-- At this point the Board can do nothing. , Mrs , Everett questioned the use, Town Counsel said that after they acquire the property if they are in violation of the Town laws' than something- can be done. fir. Mrs. Everett gave the Board a copy of a covenant that states the 'rules and regulations of their association. (see attached) Town Counsel Townsel. said that this was. a private war of zoning.. He also stated that the Town cannot enforce -this . He explained that only somebody who is a property owner can do, something about Y this , Sed.. Teary said that ,the association should'. contact the prospective buyer and furnish hire w-ith a, copy. of the covenant.
